RESOLUTION NO. 2008-474
RESOLUTION FIXING THE TIME AND PLACE OF
HEARING AND NOTICE TO BE GIVEN ON THE
VACATION, SALE AND CONVEYANCE OF A PORTION OF
WEST AIRLINE HIGHWAY ADJACENT TO 3533 WEST
AIRLINE HIGHWAY TO BUDKE PROPERTIES AS
JUNE 23, 2008, AT 5 : 30 P.M. IN CITY HALL
COUNCIL CHAMBERS, WATERLOO, IOWA AND
INSTRUCTING THE CITY CLERK TO PUBLISH THE
NOTICE OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS :
Section 1 . That the Council of the City of Waterloo, Iowa
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa at 5 : 30 p.m. on the 23rdday of June, 2008, for the purpose
of considering and acting upon a proposal to vacate, sell and
convey a portion of West Airline Highway adjacent to 3533 West
Airline Highway to Budke Properties, and legally described as
follows :
Parcel "E"
That part of the Northwest Quarter of the Northeast
Quarter (NW 1-4 NE �) of Section No. 8, Township No. 89
North, Range No. 13 West of the Fifth Principal
Meridian, City of Waterloo, Black Hawk County, Iowa,
described as follows :
Commencing at the Northwest corner of Northwest
Quarter of the Northeast Quarter, point being a found
z rebar in P. C. C, pavement;
thence along the West line of said Northwest
Quarter of the Northeast Quarter South 00°041-4' East a
distance of 33 . 0 feet to a set &�" rebar with license
#16264 ;
thence parallel with the North line of said
Northwest Quarter of the Northeast Quarter Due East a
distance of 160 . 6 feet to the East line of the West 160
feet of said Northwest Quarter of the Northeast Quarter
per Plat of Survey date 8/19/2005 and recorded in Fee
Book #2006 17726 in the Office of the Black Hawk County
Recorder, point being a set '-I" rebar with license
#16264 ;
thence along said East line South 00°10'-�' East a
distance of 67 . 0 feet to the existing Southerly right-
of-way line of West Airline Highway, point being a
found 1"o. d. iron pinched pipe;
thence along said existing Southerly right-of-way
line Due West a distance of 160 . 7 feet to the West line
of said Northwest Quarter of the Northeast Quarter,
point being a set '-� rebar with license #16264;
thence along said West line North 00004 ' West a
distance of 67 . 0 feet to the point of beginning.
Containing 10, 765 sq. ft. including 10, 765 sq. ft . of
right-of-way, all in the City of Waterloo, Black Hawk
County, Iowa.
Subject to easements, restrictions, convenants,
ordinances and limited access provisions of record and
not of recr 1.
