RESOLUTION NO. 2008-493 RESOLUTION FIXING THE TIME AND PLACE OF HEARING AND NOTICE TO BE GIVEN ON THE VACATION OF A DRIVEWAY EASEMENT AND A TELEGRAPH EASEMENT ON LOTS 1 THROUGH 3 IN BLOCK 3 OF JAMES EGGERS ADDITION AND UNPLATTED LAND ADJACENT ON CITY-OWNED PROPERTY GENERALLY LOCATED AT THE SOUTHWEST CORNER OF COMMERCIAL STREET AND MULLAN AVENUE AS JUNE 23, 2008, AT 5 : 30 P.M. IN CITY HALL COUNCIL CHAMBERS, WATERLOO, IOWA AND INSTRUCTING THE CITY CLERK TO PUBLISH THE NOTICE OF HEARING. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: Section 1 . That the Council of the City of Waterloo, Iowa shall meet at City Hall Council Chambers in the City of Waterloo, Iowa at 5: 30 p.m. on the 231" day of June, 2008, for the purpose of considering and acting upon a proposal to vacate a driveway easement and a telegraph easement on Lots 1 through 3 in Block 3 of James Eggers Addition and unplatted land adjacent on city-owned property generally located at the southwest corner of Commercial Street and Mullan Avenue, and legally described as follows : Driveway Easement Abutting that part of Fractional Lot Two (2) in Fractional Block Three (3) in James Eggers Addition to the Village (now City) of Waterloo, Iowa, described as the Northwesterly (NWly) Twenty (20) feet of the Southeasterly (SEly) Thirty nine and fifty-two hundredths (39 . 52) feet of said Fractional Lot Two (2) , all in the City of Waterloo, Black Hawk County, Iowa. Telegraph Easement Fractional Lots 1 and 2 and the Southeasterly 40 feet of Lot 3, Block 3, James Egger' s Addition to the Village of Waterloo, Black Hawk County, Iowa .
