RESOLUTION ORDERING THE CONSTRUCTION OF THE
F. Y. 2008 WEST COMMERCIAL STREET EXTENSION
H v STORM WATER PUMPS, CONTRACT NO. 750 .

WHEREAS, by Resolution No. 2008-601, plans, specifications,
o -±Q�rm of contract, etc. , for the F. Y. 2008 West Commercial Street
extension Storm Water Pumps, Contract No. 750, in the City of
- "RA erloo, Iowa, have been approved and adopted by this Council
f�er the hearing prescribed by statute.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TERLOO, IOWA, that it is deemed advisable and necessary and it
is so ordered on motion by this Council that the said
-aVrovements be constructed in accordance with said plans and
`sr�icifications .

v That the work herein ordered is to be paid in monthly
estimates, in cash, on the basis of 90 percent of the work as the
9e is completed and materials delivered and the work approved,
except that before the last month ' s payment is made the
�60ijtractor may be required to furnish the City Council vouchers
Mowing that all subcontractors and workmen and persons
X,urnishing materials have been fully paid for such materials and
a4jor, and that the City may retain the last month ' s payment for
a period of 31 days following such completion and approval,
unless satisfied that materials, men and laborers have been paid.
That said work shall be done by contract and shall be
commenced promptly after receipt of "Notice to Proceed".
PASSED AND ADOPTED this 14th day of July, 2008 .
