Mayor John R. Rooff in the Chair. Roll Call: Anders, Jordan, Krizek, Murphy, Gronen, Getty, Berry. Invocation by: Reverend Duane Lindberg, Ascension Lutheran Church. Pledge of Allegiance: Cammie Scully, Director of Cultural & Arts Commission. 115092 - Jordan/Murphy that the Agenda, as proposed, for the Regular Session on Monday, April 23, 2001, at 5:30 p.m., be accepted and approved. Ayes: Seven. Motion carried. 115093 - Murphy/Gronen that the Minutes, as proposed, for the Regular Session on Monday, April 16, 2001, at 5:30 p.m. be accepted and approved. Ayes: Seven. Motion carried. Police Chief Tom Jennings read a proclamation declaring April 22-28, 2001, as Crime Victims' Rights Week. Mayor Rooff read a proclamation declaring April 29 -May 5, 2001, as Skip a Meal for the World's Children Week. Councilperson Deb Berry read a proclamation declaring April 2001 as Fair Housing Month. Councilperson Bill Gronen read a proclamation declaring May 2001 as Adolescent Pregnancy Prevention Month. Councilperson Jerry Anders read a proclamation declaring May 2001 as Multiple Sclerosis Awareness Month. HEARINGS AND BIDS 115094 - Jordan/Murphy that proof of publication of notice of public hearing on the proposed F.Y. 2001 Right -of -Way Mowing, as published in the Waterloo Courier on April 16, 2001, be received and placed on file. Ayes: Seven. Motion carried. 115095 - This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Resolution adopted and upon approval by Mayor assigned No. 2001-164. PETITIONS FROM PUBLIC 115102 - Gronen/Murphy that communication from City Engineer transmitting request of Oliver E. Bryant, Jr., for a waiver for a concrete driveway to be located at 927 Anthony Street, together with recommendation of approval, be received, placed on filed and "Resolution approving said request", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2001-165. 115103 - Gronen/Murphy that communication from City Engineer transmitting request of Sandra J. Sturch for a waiver for a concrete driveway to be located at 205 Blowers Avenue, together with recommendation of approval, be received, placed on file and "Resolution approving said request", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2001-166. 115104 - Gronen/Murphy that communication from Assistant City Planner transmitting request of Paul Wieland to sell and convey property generally located at the northwest corner of Halstead and Merriman Streets for $500.00 be received, placed on file and "Resolution setting date of hearing as May 21, 2001, at 5:30 p.m. in the City Hall Council Chambers on the above described request", be adopted and City Clerk instructed to publish notice of same. DOCUMENTS 115105 - Anders/Jordan that communication from Facilities Maintenance Supervisor transmitting extension of contract with Service Roofing Company to April 30, 2001, in conjunction with Reroofing of West Wing at Waterloo Center for the Arts due to weather related delays be received, placed on file and "Resolution approving said contract extension", be adopted and Mayor and City Clerk authorized to execute same. Resolution adopted and upon approval by Mayor assigned No. 2001-168. 115106 - Anders/Jordan that communication from Waterloo Water Works General Manager transmitting Release of Real Estate Mortgage for Donald E. and Carole J. Mountain, 7926 Kimball Avenue, for payment of Promissory Note in conjunction with Kimball South Rural Water Main Project be received, placed on file and "Resolution approving said release of real estate mortgage", be adopted and Mayor and City Clerk authorized to execute same. RESOLUTIONS TO BE ADOPTED 115108 - Anders/Krizek that "Resolution authorizing release of security interest in certain motor vehicles of the National Cattle Congress", be adopted and Mayor authorized to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2001-171. 115109 - Anders/Krizek that "Resolution supporting John Foley, DBA Waterloo Apartments Partners, L.L.C., to be eligible for low-income Housing and Historic Tax Credits to assist financing of the Whittier and Emerson School renovations", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2001-172. ORDINANCES TO BE ADOPTED 115110 - Getty/Jordan that "an Ordinance amending the 2000 Traffic Code by adding Subsection (87a) Rath Street to Section 553, No Parking Here to Corner (restrict parking on north side of Rath Street 82 ft. east from corner of Court and Rath Streets)", be received, placed on file, considered and passed for the second time. Prior to a vote on the above motion, the following comments were heard. Allen Tarr, 301 Rath Street, presented a letter he received from the Traffic Operations Department dated October 24, 2000, informing him that the city had received a request from Quality Mat Company to restrict parking on both sides of Rath Street from Vinton Street to Dunham Place because of the truck traffic and the narrow streets. Mr. Tarr also presented a petition presented to the council in October 2000 from residents on Rath Street between Vinton Street and Dunham Place asking to keep curb parking on the odd number side of Rath Street. Mr. Tarr stated he did not receive notification from the city this time because he lives at the end of the block, but he feels this affects the whole neighborhood. Mr. Tarr presented the real estate assessment and tax information for 410 Rath Street which shows Ramona and Michael Rooff as the deed holders and Michael Narey as the contract buyer, and 311 Rath Street which shows Peter Stroh as the deed holder and tax mail address to Bernie Stroh. Mr. Tarr stated that the gate at Quality Mat Company after Rath Street was reconstructed measured 30 feet wide, and he believes the gate could be made wider. Mr. Tarr stated the semis from Quality Mat do not need to turn at the driveway but could travel on Rath Street east to Dunham Place. Mayor Rooff stated that the ordinance change is only restricting parking 82 feet east from the corner of Court and Rath Streets, not the full block. Mayor Rooff stated that the notification letter was sent only to residents living in the 300 block of Rath Street. Mayor Rooff noted that the petition includes residents in the 200 and 300 blocks of Rath Street. Mr. Tarr showed pictures of Court and Rath Streets. Mr. Tarr commented that the property has been empty for years with boarded up windows and a dilapidated front porch. Mr. Tarr reported that he called Code Enforcement Officer Virgil Carson to review the property. Lou Cutwright, Building Official, stated that this property is in the process of investigation and the city is sending a letter to the owner. Mr. Tarr stated that this property is in the Brownfield area, and the residents would like to have input on the funds the city receives for the area. April 23, 2001 Page 4 ORDINANCES TO BE ADOPTED CONTINUED Patricia Uttng, 417 Rath Street, stated she owns six properties in the 400 block of Rath Street. Ms. Uttng commented that vehicles are only allowed to park on one side of Rath and Court Streets. Ms. Uttng asked where will people park if you take away parking, as she feels their vehicles will end up in the yards. Mr. Uttng stated this man does not need that room. Councilperson Berry stated that she looked at the property and spoke with Mr. Stroh a few weeks ago. Councilperson Berry stated she understands Mr. Stroh's needs, but she does not feel the city should take away the parking from the residents. Councilperson Berry suggested that Mr. Stroh do other things to make it easier for the semis. Councilperson Berry stated that she is not convinced this is a good move. Councilperson Getty stated that Mr. Stroh is requesting to restrict the parking on the north side of Rath Street so that semis are able to enter and exit from the driveways. Councilperson Getty commented that this 80 feet only affects one home, and there is room for parking on Court Street. Sandie Greco, Superintendent of Traffic Operations, stated that years ago there was one hour parking in this area and it became street parking during the street reconstruction. Councilperson Berry stated that the neighbors are willing to work with Mr. Stroh and are willing to move the cars at his request. Councilperson Berry stated that the semis are only at Quality Mat a couple of times per week. Councilperson Murphy stated that it appears only two parking spots would be displayed, and they could park on the corner of Court Street. Councilperson Jordan stated he agrees that it does not appear that this restriction will affect that many parking spots. Councilperson Jordan stated that he talked with Mr. Stroh, and Mr. Stroh felt this was a safety issue. Councilperson Jordan stated he felt it could be tough to knock on neighbors doors every time Mr. Stroh needs them to move their vehicles. Councilperson Jordan stated that Mr. Stroh made it sound like the semis are there every day. Ellen McNamara, 407 Rath Street, stated that she is home most of the time, and she asked Quality Mat to let them know and they would move the vehicles, and he said that would be no problem. Ms. McNamara stated if we remove parking what happens during the holidays. Ms. McNamara commented that Court Street is pretty much full most of the time, and she feels with maybe two semis per week it is silly to restrict parking. Ms. McNamara stated that if Mr. Stroh is allowed this 82 feet, he will want another 80 feet on the other end. Ms. McNamara stated residents need parking for company. Ms. McNamara stated she believes cars parked on the street slows traffic, and if parking is lessened, it will increase speeding. Mr. Tarr stated that there is no reason why the semis are not able to go out Dunham Place. Jordan/Murphy that "an Ordinance amending the 2000 Traffic Code by adding Subsection (87a) Rath Street to Section 553, No Parking Here to Corner (restrict parking on north side of Rath Street 82 feet east from corner of Court and Rath Streets) be tabled indefinitely. BILLS PAYMENT 115111 - Krizek that "Resolution approving Schedule AP640, pp. 1-47, dated April 23, 2001, in the amount of $1,454,243.73, a copy of which is on file in the City Clerk's Office", be adopted, together with recommendation of approval of the Finance Committee. Ayes: s -ed. Resolution adopted and upon approval by Mayor assigned No. 2001-173. NEW BUSINESS 115112 - Jordan/Murphy to instruct Building Official to prepare plans, specifications, form of contract, etc. in conjunction with West 5th Street Parking Ramp Repair, be received, placed on file and approved. Resolution adopted and upon approval by Mayor assigned No. 2001-174. 115115 - Jordan/Murphy that "Resolution setting date of hearing on plans, specifications, form of contract, etc. as May 21, 2001, at 5:30 p.m. in the City Hall Council Chambers and taking of bids on the above described project", be adopted and City Clerk instructed to publish notice of same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2001-175. 115116 - Anders/Jordan that communication from Waterloo Water Works General Manager transmitting request of Charles P. and Mary Sue Dwyer to certify $1,585.69 for work performed by Waterloo Water Works at 1933 West 3rd Street, together with recommendation of approval of Board of Waterloo Water Works Trustees, be received, placed on file and "Resolution approving said request", be adopted. April 23, 2001 BONDS 115119 - Anders/Murphy Page 6 that the report of the City Attorney and list of bonds filed with the City Clerk through April 23, 2001, be received, placed on file and report and bonds be approved. Ayes: Seven. Motion carried. ADJOURNMENT 115120 - Jordan/Gronen that the Council adjourn at 6:34 p.m. Prior to a vote on the above motion, the following comments were heard. Robert Sieglaff, 914 West 3rd Street, stated that the article in the Courier mentioned that the city would be running the street sweepers this week. Mr. Sieglaff stated that the city has not implemented odd/even parking making it impossible to sweep in his area. Mr. Sieglaff stated that until the city does this, we will not get the city cleaned up. Mr. Sieglaff stated the police department could enforce odd/even parking, and he would appreciate the council getting this done. Mayor Rooff stated he will ask the Superintendents of Street and Traffic Operations to look at odd/even parking on those streets in Ward 3 due to the multi -family homes.
