RESOLUTION NO. 2008-776
RESOLUTION GRANTING PERMISSION TO DEAN
WOELBER FOR A WAIVER FOR A CONCRETE DRIVEWAY
TO BE LOCATED AT 1825/1827 CASTLE STREET, AND
AUTHORIZING CONSTRUCTION OF A CONCRETE
DRIVEWAY WITH ELIMINATION OF THE SIDEWALK
SECTION DUE TO THE INABILITY TO MEET
REQUIREMENTS OF THE DRIVEWAY AND SIDEWALK
POLICY, PARAGRAPH 1 .
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
WHEREAS, the City Engineer has made written application to
the City Council asking that Dean Woelber be authorized and
permitted to construct a concrete driveway with elimination of
the sidewalk section due to the inability to meet requirements of
the driveway and sidewalk policy, paragraph 1 to be located at
1825/1827 Castle Street, and legally described as follows :
1825 Castle Street
Unplatted Waterloo West part of the Northeast 1-4 of the
Northeast k of Section 20 Township 89 Range 13
described as commencing at a point 230 feet West of the
point of intersection of the West line of South Hackett
Road and the North line of Section 20; thence West 100
feet; thence South 132 feet; thence East 100 feet;
thence North 132 feet to point of beginning; except the
North 30 feet of Section 20 Township 89 Range 13, all
in the City of Waterloo, Black Hawk County, Iowa;
1827 Castle Street
Unplatted Waterloo West part of the Northeast k4 of the
Northeast li of Section 20 Township 89 Range 13 described as
commencing at a point 230 feet West of the point of
intersection of the West line of South Hackett Road and the
North line of Section 20; thence West 100 feet; thence South
132 feet; thence East 100 feet; thence North 132 feet to
point of beginning; except the North 30 feet of Section 20
Township 89 Range 13, all in the City of Waterloo, Black
Hawk County, Iowa;
and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Dean Woelber to construct a concrete driveway
with elimination of the sidewalk section due to the inability to
meet requirements of the driveway and sidewalk policy, paragraph
1 to be located at 1825/1827 Castle Street, subject to the
following conditions:
1 . Work to be performed by an approved and bonded
contractor.
2 . A permit is to be obtained from the office of the City
Engineer prior to construction.

3 . All work shall be performed under the supervision of
the City Engineer and at no cost to the City of
Waterloo.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk
County Auditor for filing in order that this said action may
become a matter of official County Record.
