ORDINANCE NO. 5143 AN ORDINANCE AMENDING ORDINANCE NO. 5079, AS AMENDED, CITY OF WATERLOO ZONING ORDINANCE, BY AMENDING THE OFFICIAL ZONING MAP REFERRED TO IN SECTION 10-4-4, A SITE PLAN AMENDMENT TO THE "R -4,C -Z" CONDITIONAL ZONING MULTIFAMILY RESIDENCE DISTRICT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: Section 1. That the Official Zoning Map referred to in Section 10-4-4, of Ordinance No. 5079, as amended, City of Waterloo Zoning Ordinance, be amended to approve a site plan amendment to the "R -4,C -Z" Conditional Zoning Multifamily Residence District, for property generally located south of 1731 West Ridgeway Avenue, just west of West 4th Street, to allow for the construction of a 7,900 square foot pain clinic and a 48 stall parking lot, legally described as follows: That part of the Northeast Quarter of the Northwest Fractional Quarter of Section 5, Township 88 North, Range 13 West of the 5th P.M., Black Hawk County, Iowa described as follows: Beginning at the intersection of the existing Northwesterly 33 -foot right-of-way of West Fourth Street (formerly US Highway 63) and the Easterly extension of the North line of Kingswood Addition, Waterloo, Black Hawk County, Iowa and Kingswood First Addition, Waterloo, Black Hawk County, Iowa; thence N 24001'44" W 278.02 feet, thence N 48°46111" E 117.00 feet; thence S 82022100" E 215.10 feet; thence Southeasterly 74.63 feet along a 100.00 -foot radius curve, concave Southwesterly, said curve having a 72.91 foot curve bearing S 60°59'10" E; thence S 39°36'20" E 34.97 feet to the said Northwesterly 33 -foot right-of- way of West Fourth Street; thence S 48°46110" W along said right-of-way 364.38 feet to the point of beginning, containing 1.61 acres; and subject to the following conditions: 1. That the location and design of access to the property be approved by the City Engineer. 2. That the final site plan meets all applicable city codes, regulations, etc. including, but not limited to, parking, landscaping, drainage, etc., including as provided by Board of Adjustment approval. Section 2. That the City Clerk be, and she is hereby directed to file a certified copy of this Ordinance with the Recorder of Black Hawk County, Iowa.
