RESOLUTION NO. 2008-889
RESOLUTION MAKING ASSESSMENT FOR REPAIRING
THE SERVICE LINE AND PREVENTION OF FURTHER
DAMAGE AT 405 ANKENY STREET.
WHEREAS, the Board of Water Works Trustees of the City of
Waterloo, Iowa, did, as provided by law, notify by written notice
the property owner of the premises known as 405 Ankeny Street to
have the service line repaired and further damage prevented, and
WHEREAS, the property owner failed to comply with the order
of the Board of Water Works Trustees, as by law provided, and
WHEREAS, the Board of Water Works Trustees proceeded to have
the work done on the premises described as 405 Ankeny Street, in
the City of Waterloo, Iowa, to comply with Ordinance No. 1118 of
the City of Waterloo, Iowa, and
WHEREAS, the Board of Water Works Trustees filed with the
City Clerk on the 25th day of September, 2008, a report filing
claim for the repairing of the service line and preventing
further damage at above described premises and same met all the
requirements of the City ordinance and have been fully completed.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the said report of the Board of Water Works
Trustees be, and the same is hereby, approved; that the work was
done under and by virtue hereby, accepted, and that the cost of
said work is hereby determined to be as follows, which amount can
be assessed over a ten-year period against the property:

Legal Description:
Lot No. One (1) and a part of Tract "C" in Urban Acres
in the City of Waterloo, Iowa, and a part of Lots Nos .
Thirty-two (32) and Thirty-three (33) in Auditor
Rainbow' s Plat No. 4 to Waterloo, Iowa, bounded as
follows : Beginning at the Southeast corner of Lot No.
One (1) in Urban Acres; thence North Zero (0) degrees
Twenty-five (25) minutes Thirty (30) seconds East along
the East lines of Lots Nos . (1) and Thirty-three (33)
Eighty-six and Twenty-six Hundredths (86. 26) feet;
thence North Eighty-nine (89) degrees Six (6) minutes
West to the East line of the West Ten and Twenty-one
Hundredths (10 . 21) feet of Lots Nos . Thirty-three (33) ,
Thirty-two (32) and Tract "C"; thence South along said
East line to the South line of Tract "C"; thence East
along the South lines of Tract "C" and Lot No. One (1)
to the point of beginning, Black Hawk County.
Unpaid Assessment : $2, 780 . 00
BE IT FURTHER RESOLVED that there be, and are hereby
assessed and levied a special tax and assessment against the
property improved, described as 405 Ankeny Street in the City of
Waterloo, Iowa, the amount of $2, 780 . 00, said assessment shall
bear interest from the date of levy of the assessment, viz:
October 6, 2008, at the rate of nine (9) percent per annum until
paid on all the unpaid amount of this assessment certified to the
County Treasurer of Black Hawk County, Iowa, and

Q o BE IT FURTHER RESOLVED that the City Clerk be, and she is
�reby instructed to notify L. Neil Chochrek, of said property,
sa�cordingly and also instructed to certify said assessment to the
�bunty Treasurer of Black Hawk County, Iowa, to be entered upon
<tie tax list to be collected as other taxes, as provided by law,
No d when collected to be credited to the Water Works Fund of said
