o mrn RESOLUTION APPROVING ENCROACHMENT AGREEMENT
ss` WITH FERNANDO MALIAS AND DIRECTING EXECUTION
OF SAID AGREEMENT BY MAYOR.
- BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
timet the Encroachment Agreement dated December 8, 2008, to allow
Arr- emergency exit door at 728 Commercial Street to encroach
approximately 35" into a public alley, legally described as
-follows :

o -- The Northeasterly three (3) feet of the Northwesterly
seven (7) feet of the Southeasterly thirty seven (37)
S feet of the twenty (20) foot wide public alley in Block
9 of the Original Plat of Waterloo West, City of
Waterloo, Black Hawk County, Iowa;
by- and between Fernando Malias, and the City of Waterloo, Iowa,
-betiand the same is hereby approved, and the Mayor and City Clerk
authorized to execute the same in behalf of the City of Waterloo,
Iowa .
PASSED AND ADOPTED this 8th day of December, 2008 .
