RESOLUTION NO. 2008-199 RESOLUTION FIXING THE TIME AND PLACE OF HEARING TO BE GIVEN ON APPLICATION OF BENTON' S READY MIX CONCRETE TO REZONE FROM "A-1" AGRICULTURAL DISTRICT TO "M-1" LIGHT INDUSTRIAL DISTRICT APPROXIMATELY 6. 85 ACRES GENERALLY LOCATED ON THE WEST SIDE OF BISHOP AVENUE BETWEEN INDEPENDENCE AVENUE AND MARTIN LUTHER KING JR. DRIVE, AS APRIL 7, 2008, AT 5 : 30 P.M. IN THE COUNCIL CHAMBERS IN CITY HALL AND INSTRUCTING CITY CLERK TO PUBLISH NOTICE OF HEARING. WHEREAS, the Council of the City of Waterloo, Iowa, shall meet in the Council Chambers in the City Hall in the City of Waterloo, Iowa, at 5 : 30 p.m. on the 7th day of April, 2008, for the purpose of considering and acting upon an application of Benton' s Ready Mix Concrete to rezone from "A-1" Agricultural District to "M-1" Light Industrial District approximately 6. 85 acres generally located on the west side of Bishop Avenue between Independence Avenue and Martin Luther King Jr. Drive and legally described as follows : All that portion of the following described land lying South of the Chicago Great Western Railroad and East of the following described line : Commencing at the Southwest corner of Section No . 20, Township No. 89 North, Range No. 12 West of the Fifth Principal Meridian; thence East along the South line of said section 1587 . 50 feet; thence North to the Southerly right of way of the Chicago Great Western Railroad: The North 75 acres of the West 120 acres of the Southwest Quarter of Section No. 20, Township No. 89 North, Range No. 12 West of the Fifth Principal Meridian, in Black Hawk County, Iowa, except the right of way of the Chicago Great Western Railroad Company, and except the following: Beginning at a point on the West line of the Southwest Quarter of said Section No. 20 that is 990 feet North of the Southwest corner of said Section; thence due North 00 degrees West along said West line 615 . 02 feet to the Southerly line of the right of way of the Chicago Great Western Railroad; thence North 79 degrees 37 minutes East along the Southerly line of said right of way 1224 feet; thence South 21 degrees 2 minutes West 490 . 65 feet; thence South 84 degrees 50 minutes West 434 . 38 feet; thence South 50 degrees 18 minutes West 234 . 25 feet; thence South 6 degrees 18 minutes West 191 . 45 feet; thence North 89 degrees 48 minutes West along a line that is 990 feet North of and parallel with the South line of said section a distance of 394 feet to the place of beginning, except that part conveyed to the City of Waterloo in 572 LD 203 .
