RESOLUTION NO. 2008-110
RESOLUTION APPROVING AND ACCEPTING TEMPORARY
EASEMENT AGREEMENT AND PERMANENT EASEMENT
AGREEMENT AND DIRECTING EXECUTION OF SAID
AGREEMENTS BY MAYOR.
WHEREAS, the Temporary Easement Agreement and Permanent
Easement Agreement of the hereinafter described parcels are for
acquisition of property generally located at the intersection of
Burton Avenue and Broadway Street in conjunction with the West
Donald Street Bike Trail Project .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the Temporary Easement Agreement and
Permanent Easement Agreement, by and between Chicago Central and
Pacific Railroad Company, for the parcel hereinafter described,
all of which are situated in the City of Waterloo, Black Hawk
County, Iowa, are accepted and approved.
Owner: Chicago Central and Pacific Railroad Company
Permanent Easement : $1, 375 . 00
A portion of the right of way of the Chicago Central
and Pacific Railroad Company in the City of Waterloo,
Black Hawk County, Iowa, described as follows :
Beginning at the point of intersection of the West
right of way line of Burton Avenue with the Southerly
right of way line of the Chicago Central and Pacific
Railroad Company;
Thence North 49038' 30" West on said Southerly right of
way line 41 . 19 feet;
Thence North 0049125" West, 25 . 79 feet;
Thence North 40039' 43" East, 46 . 79 feet to said West
right of way, line;
Thence South 0049' 25" East on said West right of way
liner, 87 . 96 feet to the point of beginning.
Described parcel contains 1, 763 square feet (0 . 04
acres) , all in the City of Waterloo, Black Hawk County,
Iowa .
Temporary Easement
A portion of the right of way of the Chicago Central
and Pacific Railroad Company in the City of Waterloo,
Black Hawk County, Iowa, described as follows :
A five (5) foot-wide strip of land being two and one-
half (2 . 5) feet on each side of the following described
centerline;
Commencing at the point of intersection of the West
right of way line of Burton Avenue with the Southerly
right of way line of the Chicago Central and Pacific
Railroad Company;
Thence North 49°38130" West on said Southerly right of
way line, 44 . 51 feet to the point of beginning of said
centerline;
Thence North 0°49' 25" West on said centerline, 24 . 55
feet;
Thence North 40039' 43" East on said centerline, 46. 80
feet;
