RESOLUTION NO. 2008-98
RESOLUTION AUTHORIZING THE SALE AND
CONVEYANCE OF A PORTION OF THE EXISTING
PARKING LOT BOUNDED BY EAST 6TH STREET,
LAFAYETTE STREET AND SYCAMORE STREET
(PARCEL K) FOR $70, 000 . 00, AND AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE AND
DELIVER DEED FOR SAME AND RESCINDING
RESOLUTION NO. 2005-1124 IN ITS ENTIRETY.
WHEREAS, the City of Waterloo, Iowa, is the owner of real
property in the City of Waterloo, Iowa, as described below, and
WHEREAS, an offer to purchase said certain parcel of real
property in the sum of $70, 000. 00, has been made by Black Hawk
County, and
WHEREAS, a public hearing was held on February 11, 2008, at
5 : 30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa,
as provided by law, by the Council of the City of Waterloo, Iowa,
on the proposal to sell and convey premises owned by the City of
Waterloo, Iowa, to Black Hawk County, and
WHEREAS, it is the opinion of this Council that sale and
conveyance should be made as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS :
1 . The following described real property, as fully
described in the published notice in the Waterloo Courier on
January 28, 2008, is not presently needed and will not be needed
in the foreseeable future for municipal purposes and its
ownership is serving no municipal purpose, and
2 . That the offer of Black Hawk County to purchase real
property for the sum of $70, 000 . 00, be and it is hereby accepted
for real property described below:
This Plat represents a survey of Parcel "K"
That part of the Lots Nos . 2 and 3 in Block No. 16,
Original Plat of Waterloo (East Side) , in the City of
Waterloo, Black Hawk County, Iowa, described as
follows :
Beginning at the most Northerly corner of said
Block No. 16, point being a found "mag" nail in A. C. C.
pavement;
thence South 49049 ' East along the Northeasterly
line of said Block No. 16 a distance of 110 . 9 feet to a
point being 25 . 0 feet distant Northwesterly, measured
at right angles, from the centerline of the main track
of the Union Pacific Railroad (formerly the Chicago and
North Western Transportation Company, formerly the
Chicago Great Western Railway Company) , point being a
found ;-�" rebar with license #16264;
thence continuing South 40006' West parallel with
said centerline a distance of 115 . 0 feet to a set "mag"
nail in A. C. C. pavement;
thence North 49049 ' West a distance of 110 . 7 feet
to the Northwesterly line of said Block No. 16;
