RESOLUTION NO. 2007-528 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF A PORTION OF THE SOUTHERLY RIGHT-OF-WAY ALONG SAN MARNAN DRIVE, FROM ANSBOROUGH AVENUE EAST TO THE QUARTER MILE POINT FOR $1 . 00, PLUS COSTS, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcels of real property in the sum of $1 . 00, plus costs, has been made by Leondorf LLC, and WHEREAS, a public hearing was held on June 25, 2007, at 5 : 30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Leondorf LLC, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS : 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on June 19, 2007, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2 . That the offer of Leondorf LLC to purchase real property for the sum of $1 . 00, and costs, be and it is hereby accepted for real property described below: Parcel "A" That part of the NW of the NW 1�4 of Section 9, Township 88 North, Range 13 West of the 5th P.M. , Waterloo, Black Hawk County, Iowa, described as follows, Commencing at the northwest corner of said Section 9; thence S 89°11' 10" E along the north line of said NW 'i of Section 9 a distance of 1323 . 82 feet to the northeast corner of said NW ',�4 NW �,4; thence S O1031129" W along the east line of said NW in NW li a distance of 33 . 00 feet to a point on the existing south right-of-way line of San Marnan Drive; thence N 89°11110" W along said right-of-way line 37 . 50 feet to the point of beginning; thence continuing N 89011110" W along said right-of-way line 534 . 10 feet; Resolution 2007-528 Page 2 thence S 88°39' 12" W along said right-of-way line 618 .90 feet; thence S 52057' 38" W along said right-of-way line 109 . 51 feet to a point on the east right-of-way line of Ansborough Avenue; thence northerly along a non-tangent curve and along a line parallel with and 54 . 00 feet easterly of the centerline of said Ansborough Avenue 63 . 64 feet, said curve having a radius of 7946 . 00 feet, concave easterly, through a central angle of 00°27' 32" and having a chord bearing N 01010133" E 63 . 64 feet; thence' N 52057' 38" E 97 . 60 feet to a point on the north line of said NW '-4; thence S 89°11110" E along said north line 1161 . 97 feet; thence S 01°31129" W 33 . 00 feet to the point of beginning, containing 50, 687 square feet, or 1 . 16 acres, more or less, all in the City of Waterloo, Black Hawk County, Iowa. Parcel "F" That part of the SW Ik of the SW � of Section 4, Township 88 North, Range 13 West of the 5th P.M. , Waterloo, Black Hawk County, Iowa, described as follows, Commencing at the southwest corner of said Section 4 ; thence S 89011110" E along the south line of said SW 1'4 of Section 4 a distance of 124 . 35 feet to the point of beginning; thence N 52°57' 38" E 5 . 78 feet; thence N 88039112" E 621 . 10 feet; thence N 89°44' 37" E 537 . 30 feet; thence S 01°31129" W 37 . 00 feet to a point on the south line of said SW 14; thence N 89°11110" W along said south line 1161 . 97 feet to the point of beginning, containing 26, 646 square feet, or 0 . 61 acres, more or less, all in the City of Waterloo, Black Hawk County, Iowa, subject to the city' s retention of a permanent easement over, under and above as shown on the final plat . 3 . That the City of Waterloo, Iowa, convey said parcels of real property to Leondorf LLC by Deed. 4 . That the Mayor and City Clerk are hereby authorized to execute and deliver deed to Leondorf LLC. 5 . That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council . 6. That the City Clerk is authorized and directed to deliver said deed of conveyance to Leondorf LLC upon receipt of the sum of $1 . 00, and costs .
