EXECUTIVE SESSION POLICY AND
PUNISHMENT FOR VIOLATION
The Waterloo City Council hereby establishes a policy concerning the confidentiality of
closed/executive sessions called by the City Council pursuant to Iowa Code Section 21.5.
It is the desire of the Waterloo City Council that any and all matters discussed in any
closed/executive session remain confidential until there is a final action by the City Council
pursuant to Iowa Code Section 21.5(3) or the mandates of 21.5(4) come into play.
Following any closed/executive session, no member of the City Council or other attendee
of the session (in person or by electronic medium), shall disclose to any person outside said
closed/executive session, the content or substance of any of the discussions which took place
during said closed/executive session. Any reports submitted to the City Council regarding the
closed/executive session or any notes taken therein, shall be turned in at the end of the
closed/executive session to the City Clerk. No writings, emails, or social media contacts shall be
made to anyone regarding the content and substance of the discussions during said
closed/executive session. This includes all of those in attendance, except City employees
fulfilling their employment responsibilities.
Any elected officials violating this confidentiality will be seen as violating the confidence
of the City Council and will be in breach of their duty of loyalty to the City of Waterloo. This
Policy authorizes the Waterloo City Council to punish any of its members who violate this
provision of confidentiality concerning closed/executive sessions.
At the request of the Mayor, Mayor Pro-Tem, City Clerk, City Council and City Attorney
shall meet in a special meeting for the specific purpose of hearing evidence concerning
accusations directed at an elected official regarding an alleged violation of confidentiality
following a closed/executive session. Said hearing shall be open for attendance by anyone and
evidence shall be presented. The City Council shall vote following the receipt of all evidence,
the vote shall be by a simple majority of Council excluding the accused. Should the accusation
prevail, the penalty shall be as follows:
(a) First Offense: Censure-A formal and public condemnation of that
Council member's violation of the closed/executive session rules of
confidentiality.
(b) Second Offense: Expulsion-Complete removal of that Council member from
any further closed/executive sessions. The duration of this expulsion shall
be set by City Council and shall be limited or expanded by considering the
severity of the violation.
