RESOLUTION FIXING THE TIME AND PLACE OF
HEARING AND NOTICE TO BE GIVEN ON THE
VACATION, SALE AND CONVEYANCE OF A PORTION OF
EAST RIDGEWAY AVENUE GENERALLY LOCATED JUST
EAST OF TEXAS STREET TO IOWA NORTHERN RAILWAY
COMPANY AS SEPTEMBER 17, 2007, AT 5 : 30 P.M.
IN CITY HALL COUNCIL CHAMBERS, WATERLOO, IOWA
AND INSTRUCTING THE CITY CLERK TO PUBLISH THE
NOTICE OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS:
Section 1 . That the Council of the City of Waterloo, Iowa
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa at 5: 30 p.m. on the 17th day of September, 2007, for the
purpose of considering and acting upon a proposal to vacate, sell
and convey a portion of East Ridgeway Avenue generally located
just east of Texas Street to Iowa Northern Railway Company, and
legally described as follows :
A part of the SW fractional 1�4 SW `4 of Section 31,
Township 89 North, Range 12 West of the 5th Principal
Meridian, City of Waterloo, Blackhawk County, Iowa
described as follows :
Commencing as a point of reference at the SW corner of
said Section 31; thence N89°37' 48"E along the south
line of said SW fractional 1-4 SW 14, 352 . 76 feet to the
east right-of-way line of the Iowa Northern Railroad
and the point of beginning;
thence N21°18' 01"W along said east right-of-way line,
32 . 12 feet to the north right-of-way line of East
Ridgeway Avenue;
thence N89°37"48' E along said north right-of-way line,
53 . 53 feet;
thence S21018' 01"E, 64 . 24 feet to the south right-of-
way line of said East Ridgeway Avenue;
thence S89°37' 48"W along said south right-of-way line,
37 . 47 feet to said east right-of-way line;
thence N21°18' 01"W along said east right-of-way line,
32 . 12 feet to the south line of said SW fractional
SW '1;
thence S89°37"48"W along said south line, 16 . 06 feet to
the point of beginning, containing 2730 square feet,
all in the City of Waterloo, Black Hawk County, Iowa,
subject to city' s retention of utilities easement over,
under and above the above described property;
for $1 . 00, plus costs .
Section 2 . That the City Clerk is hereby directed to
publish notice of the time and place of said hearing in the
Waterloo Courier.
