AN ORDINANCE VACATING AN ALLEY LOCATED WITHIN
BLOCK 7 OF DOES ADDITION SUBJECT TO THE
RETENTION OF A UTILITY EASEMENT OVER, UNDER
AND UPON THE AREA TO BE VACATED, AND SUBJECT
TO THE APPLICANT, KWIK TRIP, INC.,
CONSTRUCTING DRIVEWAYS OFF SOUTH STREET FOR
1009 SOUTH STREET AND 1017 SOUTH STREET, IN
THE CITY OF WATERLOO, BLACK HAWK COUNTY,
IOWA.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO,
IOWA, as follows:
The 20 foot wide alley as platted in Block 7 of Does
Addition in the City of Waterloo, Iowa lying
Northwesterly of a line drawn from the Easterly most
corner of Lot 10 said Block to the Southerly most
corner of Lot 1 said Block, and lying Southeasterly of
a line drawn from the Northerly most corner of Lot 6
said Block to the Westerly most corner of Lot 5 said
Block, excluding the Southeasterly 3.63 feet thereof;
subject to city's retention of a permanent utility
easement over, under and upon all;
shall be, and the same is hereby vacated.
