ORDINANCE NO. 5134
AN ORDINANCE VACATING A PORTION OF THE PUBLIC
ALLEY LOCATED WITHIN WILBY'S ADDITION,
GENERALLY LOCATED ALONG THE NORTH SIDE OF
GLENWOOD STREET, WEST OF LINDEN AVENUE IN THE
CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO,
IOWA, as follows:
The Twenty (20) foot wide public alley as platted in
Wilby's Addition lying Northerly of a line drawn
between the Southeasterly corner of Lot 24 in Wilby's
Addition to the Southwesterly corner of Lot 12 in
Wilby's Addition and lying Southerly of the Westerly
extension of the South line of Lot 18 in Wilby's
Addition, subject to reservation of easements for
ingress and egress and easements for access to public
and private utilities facilities and infrastructure to
operate, inspect, maintain, repair, reconstruct, and
remove same in, upon, beneath, over and across the
vacated alley as described above except the Northerly
Twenty (20) feet thereof, said easement being for the
benefit of Lot 12 in Wilby's Addition;
And also;
The Twenty (20) foot wide public alley as platted in
Wilby's Addition lying Easterly of a line drawn between
the Southwesterly corner of Lot 18 in Wilby's Addition
to the Northwesterly corner of Lot 12 in Wilby's
Addition and lying Westerly of a line drawn between the
Southeasterly corner of Lot 13 in Wilby's Addition to
the Northeasterly corner of Lot 7 in Wilby's Addition;
shall be, and the same is hereby vacated, subject to the
following conditions:
1. That trees or shrubs be planted within the east -west
portion of the vacant alley to screen the Public Works
Facility from the homes to the south.
2. That an access easement be retained over the north -
south portion of the vacated alley to provide access to
717 Glenwood Street and the vacant lot north of 717
Glenwood Street.
