ORDINANCE NO. 5161 AN ORDINANCE AMENDING ORDINANCE NO. 5079, AS AMENDED, CITY OF WATERLOO ZONING ORDINANCE, BY AMENDING THE OFFICIAL ZONING MAP REFERRED TO IN SECTION 10-4-4, REZONING CERTAIN PROPERTY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: Section 1. That the Official Zoning Map referred to in Section 10-4-4, Rezoning Certain Property, of Ordinance No. 5079, as amended, City of Waterloo Zoning Ordinance, be amended to rezone the property legally described as follows: That part of the Southeast Quarter of the Southeast Quarter of Section No. 33, Township No. 89 North, Range No. 13 West of the Fifth Principal Meridian, Black Hawk County Iowa, described as follows: Beginning at a point which is 304.4 feet North and 63.10 feet West of the Southeast corner of said Section 33; thence NO2°45'20"E a distance of 85.16 feet to a point which is 59.00 feet West of the East line of said Section 33; thence N78000'00"W a distance of 162.92 feet to a point which is 185.3 feet West (as measured along a line which is parallel with the South line of said Section 33) from the West line of existing Ansborough Avenue and 420.6 feet North (as measured along a line that is parallel with the East line of said Section 33) from the South line of said Section 33, thence SO°00'00"W along a line which is parallel with the East line of said Section 33 a distance of 116.20 feet; thence S88059'29"E along a line which is parallel with the South line of said Section 33 a distance of 155.29 feet to the point of beginning. The East line of the Southeast 1-4 of said Section 33 is assumed NO°00100"E; now zoned on the Official Zoning Map of Waterloo, Iowa, approximately 1.24 acres of land located at 3026-3032 Ansborough Avenue, as "C-1" Neighborhood Commercial District, be and the same is hereby zoned as "C -1,C -Z" Conditional Zoning Neighborhood Commercial District as above described, subject to the following condition: 1. That the use of the site shall be limited to a restaurant facility, and any use permitted in the "C-1" Neighborhood Commercial District, except that the site shall not be used for an animal hospital, veterinary clinic, car wash, commercial parking lot, gas station, service station or alcohol sales use. Section 2. That the City Clerk be, and she is hereby directed to file a certified copy of this Ordinance with the Recorder of Black Hawk County, Iowa.
