RESOLUTION NO. 2007-912 RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION CONTRACTS TO SELL REAL PROPERTY TO THE CITY AND ACCEPTING AND APPROVING CERTAIN DEEDS, AND RESCINDING RESOLUTION NO. 2007-764 IN ITS ENTIRETY. WHEREAS, the City of Waterloo, Iowa, has had all the parcels described herein appraised and the fair market value ascertained, and WHEREAS, the acquisition of the hereinafter described parcels is necessary to carry out the Donald Street Trail Project, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the contract for the parcels hereinafter described to sell the same to the City of Waterloo, Iowa, all of which are situated in the City of Waterloo, Black Hawk County, Iowa, are accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the agreement to purchase the properties from the owners thereof, and the deeds for the conveyance of the same are also accepted and approved and the City of Waterloo is directed to pay for the properties and the incidental expenses necessary to the consummation of the sales from City funds . The subject parcels are: Waterloo Water Works Board of Trustees Owner Deed Nos. 140543 and 159177 A portion of the land described in Deeds to the City of Waterloo, Iowa, recorded as Deed 140543 and Deed 159177 in the office of the Black Hawk County, Iowa Recorder, described as follows : Beginning at the Northwest corner of the land described in said Deed 140543 (the point of intersection of the South right of way line of Walker Street and the East right of way line of Longfellow Avenue) ; Thence North 89°16' 24" East on the South right of way line of Walker Street, 739. 20 feet to the West line of the East Thirty (30) feet of Lot Eleven (11) of Whitney Addition to Waterloo, Iowa; Thence South 0°11134" East on said West line, a distance of 25 . 00 feet; Thence South 89016' 24" West, 664 . 10 feet; Thence North 79°24' 19" West, 76 . 41 feet to the West line of said land described in Deed 140543; Thence North 0025' 26" West on said West line, 10 . 00 feet to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa.
