RESOLUTION NO. 2007-925
RESOLUTION GRANTING PERMISSION TO JUSTIN J.
ATEN FOR A WAIVER FOR AN ASPHALT DRIVEWAY TO
BE LOCATED AT 1540 ARCHER AVENUE, AND
AUTHORIZING CONSTRUCTION OF AN ASPHALT
DRIVEWAY AND PLACING A DRIVEWAY OR SIDEWALK
ON CITY RIGHT-OF-WAY ON AN UNIMPROVED STREET.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
WHEREAS, the City Engineer has made written application to
the City Council asking that Justin J. Aten be authorized and
permitted to construct an asphalt driveway and authorizing
construction of an asphalt driveway and placing a driveway or
sidewalk on city right-of-way on an unimproved street to be
located at 1540 Archer Avenue, and legally described as follows:
Lot 20 a tract of land in the Southwest li of the
Northeast 1i of Section No. 29, Township 89 North, Range
No. 12 West of the 5th principal meridian, Black Hawk
County, Iowa, described in the manner following:
Commencing at a point 635 feet east and 497 . 46 feet
south of the Northwest corner of the Southwest 1�4 of the
Northeast 1�4 of Section 29-89-12, and extending west
parallel with the North line of the South '-i of the
Northeast 14 of Section 29-89-12, 220 feet, thence South
parallel with North and South center line of Section
29-89-12, 142. 92 feet, thence East parallel with the
North line of Archer Street, 220 feet, thence North
144 . 92 feet to point of beginning.
Except that part contained in a survey of Parcel K of
the Northeast Quarter (NE 1-4) , Section 29, Township 89
North (T89N) , Range 12 West (R12W) of the Fifth
Principal Meridian (5th P.M. ) , a part of the Maywood
Farms Survey, now a part of the City of Waterloo, Black
Hawk County, State of Iowa, more particularly described
as follows:
Commencing at the Northwest Corner of the Southwest
Quarter of the Northeast Quarter (SW 1-4, NE 14) of said
Section 29; thence South 497 . 46 feet (measured as
S00004' 51"W) along the West line of said Southwest
Quarter of the Northeast Quarter (SW 3'4, NE 'A) ; thence
East 635 feet (measured as S89°44' 08"E, 635. 15 feet)
along a line parallel to the North line of said
Southwest Quarter of the Northeast Quarter (SW 1�4, NE
1,4) , to a point on the West line of Short Street and the
Northeast Corner of Lot 20 in the Maywood Farms Survey;
thence S00°09' 31"W 74 . 94 feet along the West line of
said Short Street and the East line of said Lot 20 to
the point of beginning of this description; thence
continuing S00009' 31"W 70 . 00 feet along the West line
of said Short Street and the East line of said Lot 20
to the Southeast Corner of said Lot 20, and the
intersection of the West line of Short Street with the
North line of Archer Street; thence N89037' 59"W, 140. 00
feet along said North line of Archer Street; thence
N00009' 31"E 70 . 00 feet along a line parallel to said
West line of Short Street; thence S89037159"E, 140 . 00
feet along a line parallel to said North line of Archer
Street to the point of beginning, containing 9, 800 . 1

square feet or 0 . 225 Acres, all in the City of
Waterloo, Black Hawk County, Iowa;
and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Justin J. Aten to construct an asphalt driveway
subject to the following conditions:
1 . Work to be performed by an approved and bonded
contractor.
2 . A permit is to be obtained from the office of the City
Engineer prior to construction.
3 . All work shall be performed under the supervision of
the City Engineer and at no cost to the City of
Waterloo.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk County
Auditor for filing in order that this said action may become a
matter of official County Record.
