("Consultant"), of Waterloo, Iowa, dated April 3, 2006, for the alternative evaluation, traffic analysis, environmental documentation, preliminary design, final design and construction review for improvements on U.S. Highway 63 between the U.S. 218 Interchange and Donald Street in Waterloo, Iowa; and WHEREAS, Preliminary Engineering (NHSX-63-6(69)--3H-07) was defined and authorized in said agreement dated April 3, 2006; and WHEREAS, the City and Consultant entered into Supplemental Agreement No. 1 dated July 27, 2007, for engineering services during the construction phase of the U.S. Highway 63 — Westfield Avenue Connection Project; and WHEREAS, the City and Consultant entered into Supplemental Agreement No. 2 dated December 14, 2007, to increase the Estimated Actual Costs for Task 15— Management of Contaminated Subsurface Soil provided by Weston Solutions, Inc., due to delay in construction progress related to inclement weather conditions and management/disposal for excess spoil; and WHEREAS, the City and Consultant entered into Supplemental Agreement No. 3 dated August 19, 2010, to include the final design of a 4-lane highway between Newell Street and Donald Street in Waterloo, Iowa, in accordance with the Preliminary Plans completed in November 2009; and WHEREAS, the City and Consultant entered into Supplemental Agreement No. 4 dated December 3, 2010, to remove the water main design from the Scope of Services; and WHEREAS, the City and Consultant entered into Supplemental Agreement No. 5 dated July 25, 2011, to include final design assistance to the Iowa DOT for U.S. 63 improvements between Franklin Street and Newell Street in Waterloo, Iowa; and WHEREAS, the City and Consultant entered into Supplemental Agreement No. 6 dated July 25, 2011, to amend the previous agreements to segregate the sanitary sewer design compensation from the Federal -Aid compensation in Supplemental Agreement No. 3 and to include additional design activities related to Supplemental Agreement No. 3; and WHEREAS, the City and Consultant entered into Supplemental Agreement No. 7 dated May 24, 2012, to amend the previous agreements to revise, repackage and split the project into two construction contracts; and WHEREAS, the City and Consultant entered into Supplemental Agreement No. 8 dated November 14, 2012, to amend the previous agreements to make various revisions to the design, add an evaluation of construction period, and combine the plans into a single construction contract; and WHEREAS, the City and Consultant entered into Supplemental Agreement No. 9 dated February 21, 2013, to amend the previous agreements to include on -call services during the bidding and construction phases of the project between Newell Street and Donald Street; and AECOM Page 2 WHEREAS, the City and Consultant entered into Supplemental Agreement No. 10 dated August 21, 2014, to include additional on -call services during the construction phase of the project between Newell Street and Donald Street; and WHEREAS, the City and Consultant entered into Supplemental Agreement No. 11, dated February 12, 2015, to include additional services requested by the City for final design of roadway lighting, enhancements and sanitary sewer between Jefferson Street and Newell Street; and WHEREAS, the City and Consultant desire to amend the previous agreements to include additional services requested by the City for final design of additional enhancements. NOW THEREFORE, it is mutually agreed to amend the original Professional Services Agreement as follows: PROJECT DESCRIPTION The project consists of U.S. 63 improvements between Jefferson Street and Donald Street in Waterloo, Iowa. The final construction plans for the roadway improvements were completed as part of the "Final Design" services for the project and by the Iowa Department of Transportation. II. SCOPE OF SERVICES The Scope of Services for this agreement includes additional services requested by the City, including: • Final design of roadway enhancements and streetscaping items between Jefferson Street and Newell Street • Additional final design activities for recreational trail between Parker and Newell Streets • Additional enhancement design to the U.S. 63 bridge over the Canadian National Railroad • Final design of enhancements under the U.S. 218 Bridge between Washington Street and Jefferson Street. These services will include production of construction documents for the current enhancement project. The project will be let as one project incorporating proposed enhancements along U.S. 63 from near U.S. Highway 218 to Parker Street. The following tasks are included in this scope. Enhancement Design and Plan Preparation Task 1 - Roadway Streetscapina. This task includes final design of streetscaping elements between Jefferson Street and Newell Street. It is anticipated that the landscaping concept will be similar to the design which was developed for the north segment between Newell Street and Donald Street, consisting of roadside trees and plantings, plus a minimum amount of other streetscape elements, such as decorative pavement, brick pavers, retaining walls, additional lighting, road -side furniture and other amenities. A portion of this work will be completed by RKLA, with assistance and coordination completed by AECOM. Task 2 - Recreational Trail Design. This task includes additional final design of a recreational trail connection along U.S. Highway 63 between Parker Street and Newell Street. It is anticipated this trail will require additional temporary easements for construction along U.S. Highway 63 right-of-way. This task includes preparation of right-of-way documents for temporary easements. Right-of-way documents for fee title acquisitions are not included. This task also includes design of retaining walls along the trail in areas of limited right-of-way. AECOM Page 3 Task 3 - Roadway Streetscapinci Under U.S. 218 Bridges. This task includes topographical survey, preliminary and final design of streetscaping and aesthetic elements between Washington Street and Jefferson Street. It is anticipated that the streetscaping concept will be similar to the conceptual design prepared for the project, and will be consistent with the U.S. 63 plans between Jefferson Street and Commercial Street, consisting of roadside trees and plantings, plus other streetscape elements, such as decorative pavement, brick pavers, retaining walls, additional lighting, road -side furniture and other amenities. A portion of this work will be completed by RKLA, with assistance and coordination completed by AECOM. Task 4 - Plan Preparation. The final plans developed under the previous tasks will be assembled into a stand-alone project suitable for an Iowa DOT letting. U.S. 63 Enhancements North of the Cedar River • Limestone Columns at Bridge • Neighborhood Monuments • Enhancements at Railroad Overpass (banners, trees, etc.) • Recreational Trail between Newell and Parker • Retaining Wall along Recreational Trail between Newell and Parker U.S. 63 Enhancements South of the Cedar River • Enhancements under US 218 Overpass • Enhancements between one-way couplets on Jefferson and Commercial Streets The project is currently scheduled for a December 2020 letting. Construction -Review Services The scope of construction -review services is not included in this agreement but will be determined at the time the services are needed and defined under a future amendment. Construction -review services include construction staking, on -site field review, materials testing and contract administration during construction. III. TIME OF BEGINNING AND COMPLETION Consultant shall not begin work under this agreement until so directed in writing by the City and they have received a copy of an executed agreement and a copy of the FHWA authorization. IV. COMPENSATION The Consultant shall be reimbursed for the actual costs incurred in accordance with Article 3 of the original Agreement. The Estimated Actual Costs, Fixed Fee, Contingency and Maximum Amount Payable for this supplemental agreement is $187,350.00, as stated below and as shown in Attachment A, and are integrated with Supplemental Agreement No. 11.
