RESOLUTION NO. 2007-433
RESOLUTION GRANTING PERMISSION TO HOWARD
ALLEN INVESTMENTS FOR A WAIVER FOR A CONCRETE
DRIVEWAY TO BE LOCATED AT 1329 LA PORTE ROAD,
AND AUTHORIZING CONSTRUCTION OF A CONCRETE
DRIVEWAY WITH ELIMINATION OF THE SIDEWALK
SECTION DUE TO THE INABILITY TO MEET
REQUIREMENTS OF THE DRIVEWAY AND SIDEWALK
POLICY, PARAGRAPH 1 .
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
WHEREAS, the City Engineer has made written application to
the City Council asking that Howard Allen Investments be
authorized and permitted to construct a concrete driveway with
elimination of the sidewalk section due to the inability to meet
requirements of the driveway and sidewalk policy, paragraph 1 to
be located at 1329 La Porte Road, and legally described as
follows:
A part of the Southeast quarter of Section No. 36,
Township No. 89 North, Range No. 13 West of the Fifth
Principal Meridian in the City of Waterloo, Black Hawk
County, Iowa, described as follows :
Beginning at the Northwest corner of Lot No. 1 in
"Garden Place" in the City of Waterloo, Black Hawk
County, Iowa; thence North 00 Degrees 00 Minutes West
454 . 1 feet along the East line of La Porte Road; thence
South 22 Degrees 32 Minutes East 313 . 4 feet; thence
South 21 Degrees 531-� Minutes East 174 . 5 feet; thence
South 89 Degrees 11 Minutes West 185. 2 feet along the
North line of said Lot No. 1 to the point of beginning
except the following described real estate:
Beginning at the Northwest corner of Lot 1 in "Garden
Place" in the City of Waterloo, Black Hawk County,
Iowa; thence North 00 Degrees 00 Minutes West 164 . 1
feet along the East line of La Porte Road; thence 89
Degrees 441-� Minutes East 120 . 7 feet; thence South 21
Degrees 531- Minutes East 174 . 5 feet; thence South 89
Degrees 11 Minutes West 185.2 feet along the North line
of said Lot No. 1 to the point of beginning, all in the
City of Waterloo, Black Hawk County, Iowa;
and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Howard Allen Investments to construct a concrete
driveway with elimination of the sidewalk section due to the
inability to meet requirements of the driveway and sidewalk
policy, paragraph 1 to be located at 1329 La Porte Road, subject
to the following conditions :
1. Work to be performed by an approved and bonded
contractor.
2 . A permit is to be obtained from the office of the City
Engineer prior to construction.

3 . All work shall be performed under the supervision of
the City Engineer and at no cost to the City of
Waterloo.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk County
Auditor for filing in order that this said action may become a
matter of official County Record.
