H WHEREAS, the City of Waterloo, Iowa, has had the parcel

0 cribed herein appraised and the fair market value ascertained,
C' WHEREAS, the acquisition of the hereinafter described parcel
necessary to carry out the Donald Street Trail Project .

4 s C NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
gTTY OF WATERLOO, IOWA, that the contract for the parcel
einafter described to sell the same to the City of Waterloo,
,,Eaa, all of which are situated in the City of Waterloo, Black
K 'k County, Iowa, are accepted and approved and the Mayor and
Ci&y Clerk are authorized and directed to execute the same in
Jew alf of the City and to execute all instruments necessary to
summate the agreement to purchase the property from the owners
reof, and the deed for the conveyance of the same are also
�rrrLepted and approved and the City of Waterloo is directed to pay
the property and the incidental expenses necessary to the
summation of the sale from City funds .

A portion of land as deeded to Michael R. and Debra K.
Goldsmith by Document Number CLD 637547 recorded at the
Black Hawk County, Iowa Recorder' s Office :
Beginning at the most Easterly corner of the land
described in said document and the Southerly right of
way line of Virginia Street; thence, N49°38' 43"W along
the said Southerly right of way line a distance of
53 . 30 feet; thence, S40021' 17"W a distance of 10 . 00
feet; thence, S49038' 43"E parallel with the said
