RESOLUTION NO. 2007-302
RESOLUTION DEDICATING AN EASEMENT
GENERALLY LOCATED ALONG THE CURVE OF WEST
4TH STREET, JUST SOUTH OF PINEHURST IN THE
CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA,
FOR MAINTENANCE AND REPAIR OF SANITARY
SEWER LINE.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO,
IOWA, that the following described property:
R2KToo, L.L.C.
A sanitary sewer easement over, under and across that
part of the Southwest Quarter (SWC) of Section Five
(5) , Township Eighty-eight North (T88N) , Range Thirteen
West (R13W) , Waterloo, Black Hawk County, Iowa,
described as follows:
Beginning at the most Northerly corner of Parcel "M",
Misc. Book 343-864 of the Black Hawk County Recorder' s
Office; thence S41002100"E Seventeen and Sixty
Hundredths (17 . 60) feet along the Northeasterly line of
said Parcel "M" to a point on a curve Seventeen (17 . 00)
feet Southeasterly of and parallel to the Southeasterly
right-of-way of West Fourth Street, as acquired by the
City of Waterloo as recorded in L. D. 549-760, aforesaid
Recorder' s Office; thence Southwesterly Twenty-five and
Three Hundredths (25. 03) feet along the arc of a non-
tangent One Thousand Ninety-six and Eighty-six
Hundredths (1, 096. 86) foot radius curve, concave
Southeasterly with a long chord of Twenty-five and
Three Hundredths (25 . 03) feet which bears S33013118"W;
thence N57025155"W Seventeen (17 . 00) feet to the
Northwesterly line of aforesaid Parcel "M", which is
also a point on aforesaid Southeasterly right-of-way;
thence Northeasterly Thirty (30 . 00) feet along the arc
of a non-tangent One Thousand One Hundred Thirteen and
Eighty-six Hundredths (1, 113 . 86) foot radius curve,
concave Southeasterly with a long chord of Thirty
(30 . 00) feet which bears N33020' 22"E along aforesaid
Southeasterly right-of-way to the point of beginning
containing 468 square feet, all in the City of
Waterloo, Black Hawk County, Iowa .

of-way of West Fourth Street to the Northeasterly line
of that parcel described and recorded in L. D. 571-101,
aforesaid Recorder' s Office; thence Southeasterly
Seventeen (17 . 00) feet along said Northeasterly line to
a point on a line Seventeen (17 . 00) feet Southeasterly
of and parallel to aforesaid Southeasterly right-of-
way; thence S48011155"W Three Hundred Twenty-three and
Thirty-nine Hundredths (323 . 39) feet along said
parallel line; thence Southwesterly Two Hundred Eight
and Seventy-seven Hundredths (208 . 77) feet along the
arc of a One Thousand Ninety-six and Eighty-six
Hundredths (1, 096. 86) foot radius curve, concave
Southeasterly with a long chord of Two Hundred Eight
and Forty-five Hundredths (208 . 45) feet which bears
S38031' 39"W, still along said parallel line to a point
on the Southwesterly line of aforesaid parcel described
and recorded in L. D. 571-101; thence Northwesterly
Seventeen and Fifty-five (17 . 55) feet along said
Southwesterly line to the point of beginning, all in
the City of Waterloo, Black Hawk County, Iowa.

A sanitary sewer easement over, under and across that
part of the Southwest Quarter (SWC) of Section Five
(5) , Township Eighty-eight North (T88N) , Range Thirteen
West (R13W) , Waterloo, Black Hawk County, Iowa,
described as follows :
Beginning at the intersection of the Southeasterly
right-of-way of West Fourth Street with the
Southwesterly line of parcel described and recorded in
Document No. 2005-15375, Black Hawk County Recorder' s
Office; thence Southeasterly Seventeen (17 . 00) feet
along said Southwesterly line to a point on a line
Seventeen (17 . 00) feet Southeasterly of and parallel to
said Southeasterly right-of-way; thence Northeasterly
One Hundred Forty-three and Twenty-eight Hundredths
(143 . 28) feet along said parallel line to a point on
the Northeasterly line of aforesaid parcel; thence
Northwesterly Seventeen and Fifty-four Hundredths
(17 . 54) feet along said Northeasterly line to a point
on aforesaid Southeasterly right-of-way line; thence
Southwesterly One Hundred Thirty-eight and Ninety-nine
Hundredths (138 . 99) feet along said Southeasterly
right-of-way line to the point of beginning, all in the
City of Waterloo, Black Hawk County, Iowa;
be and the same is hereby dedicated as right-of-way easement for
maintenance and repair of sanitary sewer line.
