RESOLUTION NO. 2020-578 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF CITY OWNED PROPERTY, LOCATED ADJACENT TO 900 COMMERCIAL STREET, WITH AN UNDIVIDED ONE-HALF INTEREST TO MARK A. HUGHES, AS SUCCESSOR TRUSTEE OF THE MAXINE C. HUGHES REVOCABLE TRUST U/A, AND AN UNDIVIDED ONE-HALF INTEREST TO MARK A. HUGHES, AS SUCCESSOR TRUSTEE OF THE MAXWELL V. HUGHES RESIDUARY TRUST, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENT, AND RESCINDING RESOLUTION NO. 1986-646 IN ITS ENTIRETY. WHEREAS, the City of Waterloo, Iowa is the owner of real property located adjacent to 900 Commercial Street, in the City of Waterloo, Iowa, as described below, and WHEREAS, in November of 1986 the City vacated the entire public alley in Original Plat of Waterloo West, Block 38, authorizing three portions to be conveyed to Max H. Hughes ($480.00), Kathryn E. Brink ($60.00) and the First Church of the Open Bible ($60.00), and WHEREAS, said property owners paid for their respectable parcels but they were never conveyed to them by deed, and WHEREAS, Kathryn Brink and the First Church of the Open Bible have sold their land and the entire block is owned by Maxwell V. Hughes Trust, and WHEREAS, the successor to the trust, Maxine C. Hughes, has now passed away and their attorney has requested the alley is deeded to the new successor, Mark A. Hughes. WHEREAS, a public hearing was held on August 3, 2020 at 5:30 p.m. in the Harold E. Getty Council Chambers, City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to convey premises owned by the City of Waterloo, Iowa, located adjacent to 900 Commercial Street, with an undivided one-half interest to Mark A. Hughes, as Successor Trustee of the Maxine C. Hughes Revocable Trust U/A, and an undivided one-half interest to Mark A. Hughes, as Successor Trustee of the Maxwell V. Hughes Residuary Trust, and WHEREAS, it is the opinion of this Council that the conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1. The real property located adjacent to 900 Commercial Street, in the City of Waterloo, Iowa, as fully described in the published notice in the Waterloo Courier on July 24, 2020, is not presently needed, and will not be needed in the foreseeable future for municipal purposes, and its ownership is serving no municipal purpose. 2. That the property located adjacent to 900 Commercial street, that was vacated and sold on November 17, 1986, to Max H. Hughes ($480.00), Kathryn E. Brink ($60.00) and the First Church of the Open Bible ($60.00), located northeast of 940 West 7th Street, in the City of Waterloo, Iowa, and legally described as follows: Resolution 2020-578 Page 2 THE EAST -WEST ALLEY IN BLOCK 38, ORIGINAL PLAT OF WATERLOO WEST, IN THE CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA. 3. That Kathryn Brink and the First Church of the Open Bible have sold their land and the entire block is owned by Maxwell V. Hughes Trust. 4. That the City of Waterloo, Iowa conveys said parcel of real property with an undivided one-half interest to Mark A. Hughes, as Successor Trustee of the Maxine C. Hughes Revocable Trust U/A, and an undivided one-half interest to Mark A. Hughes, as Successor Trustee of the Maxwell V. Hughes Residuary Trust, by quit claim deed. 5. That the Mayor and City Clerk are authorized and directed to execute said deed. 6. That the original of said quit claim deed fully executed and acknowledged, is hereby approved and confirmed by this Council. 7. That the Community Planning and Development Director is authorized and directed to deliver said deed of conveyance to Mark A. Hughes. 8. That Resolution No. 1986-646 be rescinded in its entirety.
