ORDINANCE NO. 5223 AN ORDINANCE AMENDING ORDINANCE NO. 5079, AS AMENDED, CITY OF WATERLOO ZONING ORDINANCE, BY AMENDING THE OFFICIAL ZONING MAP REFERRED TO IN SECTION 10-4-4, A SITE PLAN AMENDMENT TO THE `'B -P" BUSINESS PARK DISTRICT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: Section 1. That the Official Zoning Map referred to in Section 10-4-4, of Ordinance No. 5079, as amended, City of Waterloo Zoning Ordinance, be amended to approve a site plan amendment to the "B -P" Business Park District, to allow for the construction of a new 10,800 square foot commercial building, located at the northeast corner of Cyclone Drive and Titan Trail, legally described as follows: A part of the NE Fractional 1-4-, Section 6, Township 88 North, Range 13 West of the 5th P.M., Waterloo, Black Hawk County, Iowa, described as follows: Commencing at the Northeast corner of said NE Fractional 1-14, thence S0004512511E along the East line of said NE Fractional 1-4 a distance of 80.00 feet to the South right-of-way line of Ridgeway Avenue (recorded as S00014152"E 80.00 feet in Deer Creek Plat No. 2): thence S87059'13"W along said South right-of-way line 594.74 feet to the Northeast corner of Lot One Deer Creek Plat No. 2 (recorded as S88035'18"W 594.81 feet); thence S01°58153"E along the East line of said Lot One 364.73 feet (recorded as S01024'08"E 364.84 feet); thence S35°12'06"W along the East line of said Lot One 489.84 feet to the Southeast corner of said Lot One and point of beginning (recorded as S35°46'37"W 489.94 feet), said point also being the Southwest corner of a tract of land described in document #2006018794 in office of the Black Hawk County recorder; S54°49'04"E along the Southerly line of said tract 300.21 feet to the Northwesterly right-of-way line of the former Chicago & Northwestern Transportation Company; thence S3500715311W along said right-of-way 888.33 feet; thence N54046'54"W 307.79 feet; thence N35013'06"E 714.38 feet; thence 74.77 feet Northerly along a 120 foot radius curve concave Westerly with long chord bearing N17022'08"E 73.56 feet; N00028'5011W 67.45 feet to the Southwest Corner of Deer Creek Plat No. 2; thence N89031'1311E 83.90 feet along the South Line of Deer Creek Plat subjo. eto ct toeea int of beginning containing6.358 acres, 7 and restrictions of record; and subject to the following conditions: all applicable city including but not landscaping, etc. 1, That the site plan meets codes, regulations, etc., limited to parking, drainage, 2, That sidewalks be constructed along all street frontages as required by the deed of dedication for this subdivision.
