QUALIFICATIONS--
Candidates for election to city offices must be eligible electors of the city. An eligible elector is a person who
meets all of the qualifications to register to vote whether or not the person is registered. Candidates who are
seeking election from wards must be residents of the ward at the time the nomination papers are filed and at
the time of the election.
NOMINATIONS--
There are three methods of getting one's name on the ballot for city elections. Ask your City Clerk or
County Auditor which of the following applies to your city:
For Cities with nominations under Chapter 44(By Convention)
Nominations are made by a convention attended by at least 10 eligible electors, including at least one eligible
elector from one-half of the voting precincts in the city.
For Cities with nominations under Chapter 45 (By Petition)
Candidates are nominated by petition. The minimum number of signatures is based on the population of the
city:

3,500 or more 25
For Cities with Primaries or Runoff Provisions(By Petition)
Candidates are nominated by petition. Each petition must include a number of signatures equal to at least 2%
of the number of people who voted to fill the same office at the last regular election, but not less than 10.
Note: A separate Guide is available for candidates who are seeking nomination by petition.

No filing fees are required.
CHECKLIST FOR NOMINATION CERTIFICATES
1. The convention:
CHECK ATTENDANCE. Be sure that there are enough people present to meet the minimum requirements of
the law:
A. At least one eligible elector from half the voting precincts in the city. Check with the County
Auditor or the City Clerk for this number.

2. The nomination certificate will be certified by the chairperson and the secretary of the convention. It must include
all of the following information:
ORGANIZATION NAME.The name of the organization may not exceed five words.
OFFICE TO WHICH EACH CANDIDATE IS NOMINATED. Including:
INDICATE IF TO FILL VACANCY. If a candidate is seeking election to fill a vacancy in a city office, be
sure to indicate that fact on the nomination certificate. For example, FOR THE OFFICE OF: Mayor,
To Fill Vacancy.
CHECK WARD OR DISTRICT NUMBER. Be sure that the district number is indicated on the nomina-
tion certificate, if needed.
NAME OF EACH CANDIDATE NOMINATED. Be sure that each candidate's name is plainly printed or typed
exactly as the candidate wishes it to appear on the ballot and in exactly the same form on the nomination
certificate and on the Affidavit by Candidate. Only the candidate's name may be used; no titles may be
included.
PLACE OF RESIDENCE. The place of residence of each nominee must be included, with the street and
number, if any.
VACANCY PROVISIONS. Specify the method that will be used to fill any vacancies.
COMMITTEE MEMBERS. Include the names and addresses of each member of the organization's executive
or central committee.
DELEGATE LIST. The name and address of each delegate or voter in attendance at the convention or caucus
must be included on the nomination certificate.
SIGNATURES OF CHAIRPERSON AND SECRETARY. The presiding officer and secretary must sign the
certificate in front of a notary public. Their addresses must also be included.
3. Filling out the affidavit by each candidate (NOMINATION CERTIFICATES MUST BE FILED WITH AFFIDAVITS BY
EACH CANDIDATE):
INCLUDE OFFICE NAME AND WARD OR DISTRICT NUMBER. Be sure that the affidavit includes the name
of the same office and ward or district number that appear on the nomination certificate.
CANDIDATE'S NAME. The candidate's name must appear on the affidavit in exactly the same form as it
appears on the nomination certificate. This must be plainly printed or typed exactly as the candidate wishes
the name to appear on the ballot. Only the candidate's name may be used; no titles may be included.
NOTARY REQUIRED. A notary public must be present when the candidate signs affidavit. The notary must
also sign the affidavit by the candidate, include the official title--Notary Public,and impress the notary's seal.
Other officers who may legally witness oaths may substitute for a notary.
CANDIDATE'S SIGNATURE. The spelling of the name, including initials, should be exactly the same as the
spelling of the name on the nomination certificate, and as printed on the affidavit. The candidate must sign
the affidavit in front of a notary public, or other officer who is empowered to witness oaths.
4. Getting ready to He:
BE SURE YOU ARE READY. Once the nomination papers have been accepted forfiling nothing can be added
to them and they can not be returned.
5. Fling:
AFFIDAVITS AND CERTIFICATE MUST BE FILED TOGETHER. No papers will be accepted without affidavits
by each candidate and the nomination certificate.
FILE AS EARLY AS POSSIBLE. Your nomination papers will be inspected for completeness before they are
accepted for filing. If the papers do not meet minimum filing requirements, they will not be accepted for filing
and will be returned. If you file early,you may have time to correct your error and to re-submit your papers.
IF YOU MAIL YOUR PAPERS. Remember that your papers must be received by the City Clerk before 5 p.m.
on September 21. Postmark dates don't count.
THE DEADLINE IS FIVE O'CLOCK. Papers presented after 5 p.m. on September 21 will be rejected.

Thursday CANDIDATE FILING DEADLINE.
September 21 Last day to file nomination papers in the office of the City Clerk. Deadline is 5 P.M.
Tuesday WITHDRAWAL DEADLINE.
September 26 Last day for candidates to withdraw by filing a written,notarized request with
City Clerk.
Tuesday OBJECTION DEADLINE.
September 26 Last day to file objections to the legal sufficiency of nomination papers or to the
eligibility of a candidate with City Clerk.
Monday POSTCARD VOTER REGISTRATION DEADLINE.
October 23 Last day to postmark or deliver postcard voter registration forms for regular
city election.
Friday VOTER REGISTRATION DEADLINE.
October 27 Voter registration for the regular city election closes at 5 p.m.
TUESDAY REGULAR CITY ELECTION DAY.
NOVEMBER 7 Polls open at 7 A.M. and close at 8 P.M. Exception: Under some conditions
the polls may be opened at noon.
Monday REGULAR CANVASS OF VOTES.
November 13 Canvass by Board of Supervisors at 9 A.M.
Thursday RECOUNT REQUEST DEADLINE.
November 16 Written request for a recount must be filed in the office of the County Auditor
by 5 p.m.
Friday CONTEST NOTICE DEADLINE.
November 17 Statement of intent to contest election must be filed with the City Clerk no
later than ten days after the election.

PART I: BALLOT PLANNING--OFFICES
• PURPOSE: To determine which offices will appear on the ballot for
the city election to be held November 7, 1989.
INSTRUCTIONS:
1. OFFICE.
List all offices that are filled by election, whether or not
the term expires at the end of 1989. Examples of offices to
include are city council member and mayor. DO NOT include
any offices that are filled only by appointment (for example,
city clerk) .
2 . TERM.
In column 2 put the number of years (2 or 4) a person elected
to a full term would serve in each office listed in column 1 .
3 . DATE TERM ENDS.
In column 3 indicate the date (1/1/90 or 1/1/92) the term ex-
pires. If the incumbent was elected or appointed to fill a
vacancy, use the expiration date of the term the last time a
person was elected to the seat for a full term.
4 . NAME OF INCUMBENT.
In column 4 list the names of all persons who are currently
holding the offices listed in column 1. Include the names of
persons who were temporarily appointed to fill vacancies in
elective offices.
5. DATE APPOINTED.
If the incumbent was appointed to the office, indicate the
date of the appointment in column 5. If the incumbent has
been elected since initially assuming office by appointment,
leave the appointment date blank.

appear on the city election ballot.
INSTRUCTIONS: Check appropriate response to the following

fice of the County Auditor no later than 5 P.M. on Fri-

PART III--TYPE OP NOMINATION PROCESS
PURPOSE: To determine which election calendar to follow in
planning elections for your city and the number of signatures
needed for nomination. PLEASE NOTE: This is now required by
law. See Iowa Code Sec. 376.6. (1989)
INSTRUCTIONS: Mark the method your city has chosen for mak-
ing nominations. For all methods other than primary elec-
tions attach a copy of the ordinance mandating your nomina-
tion process.

As promised, I have MORE information for you concerning the 1989
Municipal Elections.
Within this packet you will find a nomination worksheet listing the
offices and number of candidates to be elected. Please proof this
information to avoid any discrepancies on your ballots. This form
does not mention public measures. Remember that these must be
delivered to the Election Office by the same deadline as your nomination
papers.
Also, if the public measure is too long to appear in its entirety on
the voting machine strip, a suninary of the question must accompany it.
In such a case, the entire question will be published and displayed
in each precinct, and the summary will appear on the voting machine
strip.
The Secretary of State's office has provided a "Candidate's Guide"
this year and to that I have fastened the appropriate nomination paper
and affidavit of candidate. Nomination papers must be complete, in-
dicating the name of the candidate as he or she wishes to have it
appear on the ballot, the -candidate's address, the office sought and the
date of the election. Eligible electors must complete their name
(signature) , address and the date when signing the petition.
The candidate must complete and sign one copy of the affidavit of candidate
form, making sure that the name form and spelling are the sane as on the
petitions. No titles, quotes, or parentheses are allowed. This form
must be notarized.

The affidavit of candidate form and the petitions for a candidate must
be bound or stapled into a single group of papers.
In cities allowing slates of candidates, only one caucus or convention
form is needed for each slate, but attached to it moist be an affidavit
of candidate for each candidate.

Office at 291-2430.

Sec. 10-1. Adoption of nomination procedure.
(a) Purpose. The purpose of this section is to designate the
methods by which candidates for elective municipal offices in the
City of Waterloo, Iowa, shall be nominated.
(b) Nominating method to be used For the 1975 municipal
election and in subsequent municipal elections of the City of
Waterloo, Iowa, all candidates for elective municipal offices shall
be nominated by the nonparty political organizations procedures
set forth in Chapter 44 and/or the petition procedures set forth in
Chapter 45 of the 1975 Code of Iowa.
The method prescribed herein for nominating candidates shall
remain in effect until or unless changed by ordinance. (Ord. No.

Sec. 10-12. Wards established;named.

The territory embraced within the city limits of the City of
Waterloo, Iowa, [shall]be divided into five(5)wards, to be called
the First,Second,Third,Fourth and Fifth Wards,the boundaries
of said wards are hereby established and defined and set out in

ARTICLE III. REGISTRATION•
DIVISION 1. GENERALLY
Sec. 10-98. "Elections" defined.
As used in this article the word "elections" shall be held to
mean general, municipal, special, school, or primary elections,
and shall include state, county, and municipal elections. (Rev.

Sec. 10-99. State law adopted; applicability.
There is hereby established for the city the plan of per-
manent registration for voters as provided by Chapter 48 of
the Code of Iowa, and all of the provisions of said Chapter 48
are hereby adopted and made applicable to this article to
the same extent as if each section of the chapter was set
out in full herein, and such plan of registration shall be used
at all elections hereafter held within the city at which regis-

Sec. 10-100. Certificate of registration: Prerequisite to vot-
ing; form; approval; entry on record.
(a) Before any person desiring to vote receives a ballot
from the judge or is permitted to enter the voting machine,
he shall sign a voter's declaration of eligibility as provided in
section 49.77 of the Code of Iowa, except that the voter's
declaration shall also include the following statement:
"I am lawfully registered in said precinct and county
under the Iowa permanent registration law."
(b) The voter's declaration of eligibility shall constitute a
certificate of registration for the purposes of this chapter pro-
vided he has otherwise complied with section 49.78 of the Code
of Iowa.

(c) The certificate of registration shall be approved by a
judge or clerk of election if the signature of the voter on
the certificate of registration and the signature on the regis-
try list appear to be the same. However, if the city uses
duplicate registration lists prepared by electrical, mechanical
or similar data process, the certificate of registration shall
be approved by a judge or clerk of the election if the person
signing the certificate of registration and the person on the
registry list appear to be the same. The voter shall present
this certificate to the judge in charge of the ballots or the
voting machine as proof of his right to vote. After voting,
the voter shall present his certificate of registration to the
judge or clerk in charge of the register of election, who shall
make entry as provided in section 10-119. The certificates
shall be arranged in alphabetical order after the close of the
election, placed in envelopes provided for that purpose, and
returned to the city clerk as commissioner of registration.

Sec. 10-101. Officers and employees to take oath.
Before entering upon his duties, each officer or clerk pro-
vided for in this article, in whatever capacity, shall subscribe
to an oath in such form as provided by the city attorney.

\\\ Sec. 10-102. Expenses to he shared by the city and the coun-
ty; appropriation of funds by the city.
The cost of material, equipment and labor for the installa-
tion and maintenance of the permanent registration system
shall be shared equally by the county and the city, and the
council and the board of supervisors shall allocate from the
general fund of the city or county sufficient funds, based
upon the estimate prepared by the commissioner of registra-
tion and subject to the approval of the council or board. (Rev.

• Sec. 10-103. Offenses enumerated; penalty.
Any officer or employee who shall wilfully fail to perform
or enforce any of the provisions of this article, or who shall
unlawfully or fraudulently remove any registration card or
record from its proper compartment in the registration rec-
ords, or who shall wilfully destroy any record provided by
this article, or any person who shall wilfully or fraudulently
register more than once, or register under any but his true
name, or votes or attempts to vote by impersonating another
who is registered, or who wilfully or fraudulently registers
in any election precinct where he is not a resident at the time
of registering, or who adds a name or names to a page or
pages, or who violates any of the provisions of this article,
shall be guilty of an offense, and upon conviction, shall be

perform all of the duties required of him by the laws of the

Sec. 10-110. General authority over registration; employment
of assistants; providing supplies.
The commissioner of registration shall have complete charge
of the registration of all qualified voters within this city; he
shall appoint such deputies and clerks as may be necessary
from the two (2) political parties receiving the highest vote
at the last general election. The number of such deputies and
clerks for all registration places, other than full or part-time
employees of tha clerk's office, shall be equally divided be-
tween the members of the two (2) political parties; these
appointments shall be subject to the approval of the council.
The commissioner of registration shall provide such printed
forms and blanks as may be ne'essary, together with such
other supplies and equipment as are necessary to properly

DIVISION 3. REGISTRATION LISTS AND RECORDS*
Sec. 10-116. Generally; original and duplicate registration
lists; lists of new registrants; furnishing to coun-
ty chairmen.
(a) The commissioner of registration shall provide for an
original list of qualified voters, indexed alphabetically, which
shall be kept at the office of the commissioner of registration
in a place and in such manner as to be properly safeguarded.
The list shall be known as the "original registration list" and
shall not be removed from the commissioner's office except
upon order of court. A second list, to be known as the "dupli-
cate registration list" shall be prepared by the commissioner

from the original registration list. The duplicate registration
list shall be open to public inspection at all reasonable times,
and duplicate lists shall be prepared upon request for the
county chairman of any political party polling in excess of
two per cent (2%) of the popular vote in the city in the last
general election. The list shall include the name, the address,
the precinct number, and the party affiliation of such voters.
(b) The commissioner of registration shall also prepare
lists of newly registered voters, indicating the name, address,
precinct number and party affiliation of such voters. The lists
shall be prepared weekly from the first day of July until the
fifteenth day of September and daily thereafter except Sat-
urdays and Sundays during the calendar months preceding
any general election, until registrations are closed for that
election. The lists shall be available to public inspection at
all reasonable times and duplicate lists shall be prepared upon
request for the county chairman of any political party polling
- in excess of two per cent (2%) of the popular vote in the
jurisdiction in the last preceding general election. (Rev. Ord.

Sec. 10-117. Registration records; form and contents.
For the purpose of expediting the work of the commissioner
of registration, for uniformity, and for preparation of ab-
stracts and other forms in use by the election boards, the
registration records shall be in a form substantially as follows:
(a) Suitable card index devices shall be provided. There
shall also be provided suitable index cards of sufficient
facial area to contain in plain writing and figures the
data required thereon. The following information con-
cerning each applicant for registry shall be printed or
typed on the card:
(1) Ward.
(2) Election precinct.
(3) If a man:

a. The name of the applicant, giving surname
and Christian names in full.
b. Residence, giving name and number of the
street, avenue, or other location of the dwell-
ing, and such additional clear and definite
description as may be necessary to give the
exact residence of the applicant.
c. Date of birth.
d. Term of residence in the United States; in
the state; in the county; in the precinct.
e. Nativity.
f. Citizenship; if naturalized, the date of papers
and court; also the date of naturalization of
parents.
g. Date of application for registration.
h. Signature of voter. The applicant, after regis-
tration, shall be required to sign his name on
both the original and duplicate registration
lists, extent that the signature shall required
only on the original registration list where
the duplicate registration list is prepared by
electrical, mechanical, or similar data process.
i. Social security number, if any.
(4) If a woman:
a. The information requested shall be the same
as for males, with such additional information
as may be necessary to determine the qualifi-
cations of the applicant for registration. Pro-
vided, that, after such original registration,
whenever any change of name shall occur, due
to marriage or divorce, such applicant shall
not be allowed to vote until she has reregis-
tered; and after such reregistration, the pre-
vious registration card shall be removed from
the files.

Sec. 10-118. Removal notices: Form; execution; validation of
registration; when voter who has moved may
vote.
Removal notices shall be provided for the use of any regis-
tered voter moving to a new location. Removal notices shall
provide space for the previous address of the voter, the ad-
dress of the exact location to which he is moving, and his
signature. Any written notification from the voter containing
the required information and signature shall be sufficient to
validate his registration. If the commissioner of registration
receives written notification of removal from any registered
voter and the notification does not contain the required infor-
mation, the commissioner shall immediately mail to the voter
at his last known address notice that his registration is de-
fective. Upon receipt of any valid removal notice, but not
later than ten (10) days before any election, the commissioner
of registration shall make entry of any change on the original
and duplicate registration Iists and the voter shall be qualified
( to vote in the new election precinct. Any voter who changes
his residence within ten (10) days preceding an election shall
be entitled to vote in the precinct where he is registered. (Rev.

Sec. 10-119. Election register: Form; contents; preparation;
use.
The commissioner of registration shall compile and shall
deliver to the judges of election in each precinct, the duplicate
registration list of the vnters in that precinct, which shall be
known as the election register. The register shall contain
the name and address of every registered voter in that elec-
tion precinct, indexed by street and house number, or alpha-
betically by surname, together with a space following each
name in which shall be recorded the words "voted," or "not
voted," the date, and if a primary election, the party, as the
case may be; also a spare for remarks in which shall be re-
corded any challenges, affidavits or other information as may
be required. The entry of the words `voted" or "not voted,"

challenge, affidavit, or ether information, shall be made by
the judges of the election immediately after approving the
certificate of registration. Duplicate registration lists may
be prepared by electrical, mechanical or similar data process.

Sec. 10-120. Maintenance of registration list: Inquiry to reg-
istered voter: challenge; rights of voter.
(a) For the purposes of preventing fraudulent voting and
for eliminating excess names, following the close of registra-
tion or at any other time as may be deemed necessary, the
commissioner of registration may send by mail to any voter
whose name appears on the original registration list, a notice
bearing a statement substantially as follows:
"You are hereby notified that your name and address ap-
pear on the original registration list as shown on the
opposite side of this card. If there is any mistake in the
above name and address, present this card at the office of
the Commissioner of Registration, No. City Hall, for
correction on or before _ _____-:_..._ 19 The
return of this card by the post office to the Commissioner
of Registration will be accepted as evidence on which to
challenge your vote on election day.

(b) Upon the return by the post office of any such notice,
the commissioner of registration shall, and at other times
may, direct an authorized clerk to check upon, in person, the
name and address of any voter, and if said voter is found to
have removed from the address as recorded on the original
registration list, the commissioner of registration shall cause .
to be entered on the election register of the proper precinct,
in the proper space opposite the said voter's name, the word
"challenged." No one so challenged shall be permitted to vote
except by complying with all the provisions applicable to the
proving of challenges. The commissioner shall make a positive

effort to maintain the registration lists as accurately as pos-
sible so as to reflect the actual qualified registered voters in

Sec. 10-121. Removal of names of deceased persons from reg-
• istration lists.
It is the mandatory duty of each local registrar and deputy
registrar of vital statistics to provide the commissioner of
registration of the city with a certified list of the names and
last known addresses of all persons of legal age who have died
in his county. Such lists shall be delivered monthly by the
tenth. The commissioner of registration shall, upon receipt
of such report. examine the original registration list and
duplicate registration list and shall remove therefrom, to
an inactive file, the registration cards of all registered per-

Sec. 10-1.22. Purge of registration lists; grounds; annual reg-
istration reports.
(a) At the close of each calendar year, clerks-of registration
shall check the original registration list for the purpose of
eliminating excess names and, to that end, they shall examine
the election registers, and whenever it appears that a regis-
tered voter has not voted at least once in four (4) calendar
years wherein elections ore held, the voter's card shall be
taken from the original and duplicate registration list.; and
placed in a transfer file and a printed postal card notice of
that fact with the information that his vote has been chal-
lenged. and that the voter must reregister to remove the chal-
lenge, shall be sent to the last known address of the voter.
(b) When removal notices are received by the registration
clerks, they shall examine the signatures and compare them
with the original and, if they are not similar, a postal card
notice specifying a refusal to transfer for that cause, shall
be sent to the applicant at the new address given.

(c) The commissioner of registration shall make, on the
first day of August of each year, a report to the secretary of
state showing the number of registered voters by party af-

DIVISION 4. PROCEDURE
Sec. 10-128. Time and manner of registration; oath of appli-
cant; when reregistration required; applicants
unable to write.
(a) The commissioner of registration, or a duly authorized
clerk acting for him, shall, up to and including the tenth day
next preceding any election, receive the application for regis-
tration of all such qualified voters as shall personally appear
for registration at the office of the commissioner or at any
other place as is designated by him for registration, who then
are, or on the date of election next following the day of making
the application, will be entitled to vote. Any qualified voter
who applies for registration shall subscribe to the following
affidavit:
"APPLICATION FOR REGISTRATION
I do solemnly swear or affirm that I am a resident
of the _ ..__ precinct, - __ ward or town-
ship, city or town of , county of
Iowa.
I have been a resident of the state of Iowa for at least
six months, of said county for at least sixty days, and
of said precinct for at least ten days. I am lawfully
eligible to vote in said state, county, and precinct.
If applicant had a prior address outside this county

of residence, date and place of birth, qualifications as
a voter, and my right to register and vote under the

(b) Upon being sworn, the applicant shall answer such
questions as are required, and the clerk shall fill out the form
which the applicant shall sign, and the applicant shall not be
required to register again for any election; however, failure
to vote at least once in four (4) calendar years wherein elec-
tions are held shall operate as a challenge, and shall require
the applicant to reregister.
(c) In case a qualified voter is unable to write his name,
he shall be required to make a cross, which shall be certified
by the signing of the name of the applicant by the registration
clerk taking the application. A qualified voter who is unable
to sign Ills name shall not be permitted to mail or hand in
removal notices allowed by this article, but must appear in
person to secure a removal of his name to his new voting

Sec. 10-129. Disabled or absent voters.
Any person entitled to register to vote who is permanently
disabled by sickness or otherwise, or who will be absent from
the election precinct until after the next succeeding election,
may, up to and including the tenth day next preceding an
election, apply in writing to the commissioner of registration
who shall thereupon forward to such voter duplicate registra-
tion cards which shall be executed by the voter before a notary

public and returned to the commissioner of registration. If
the registration cards are properly executed and show that the
voter is duly qualified, then the cards shall be placed in the

Sec. 10-130. Permanent and branch locations for registration;
hours of operation; when branch locations to be
established; registrars.
(a) The commissioner of registration shall establish a per-
manent registration place in the office of the clerk or else-
where in the city hall. The permanent registration place shall
be open at all times as are other city offices and at such other
times as the branch registration places are open as provided in
this section.
(b) In any county, where permanent registration applies,
the county auditor shall establish a permanent registration
place in the office of the auditor or elsewhere in the court-
house. The permanent registration place shall be open at all
times when other county offices are open. The permanent reg-
istration place shall also be open at least two evenings from
5:00 p.m. until 8:00 p.m., and at least one Saturday from 8:00
a.m. until 5:00 p.m., during the thirty-day period preceding
any election for which registration is required.
(c) The county auditor shall further establish at least one
branch registration place in every city, town, and township
under his jurisdiction that has a population of one thousand
or more during the thirty-day period prior to the closing of
the election register for any election for which registration is
required. Such branch registration places shall be open during
the evening hours upon such days and upon such Saturdays
as the auditor determines will be a convenience to the eligible
voter required to register pursuant to this chapter.
(d) Any person who resides in a town or township in which
a branch registration place is not maintained, may register at
the, nearest branch registration place or the permanent reg •
-
istration place.

(e) The city clerk shall establish at points within the city
a sufficient number of branch registration places at least
thirty (30) days prior to the close of the election register for
any election for which registration is required. Such branch
registration places shall be open during the evening hours upon
such days and upon such Saturdays as the city clerk deter-
mines will be a convenience to the eligible, voter required to
register pursuant to this chapter.
(f) The county auditor and city clerk shall give notice of
the places and times such branch registration places will be
open by publication in a newspaper of general circulatior
within the respective county or city at least one week prior
to the first time such branch registration places will be open.
(g) If petitioned by one (1) or by both of the official
county chairmen of the two (2) political parties polling the
highest vote in the jurisdiction at the last preceding general
election, the commissioner of registration shall establish at
least two (2) branch registration places in the city, taking into
consideration the convenience of the voters. If petitioned by
one (1', or by both of the official county chairmen of the two
(2) political parties polling the highest vote in the jurisdiction
at the last preceding general election, the commissioner shall
provide for additional branch registration places for each ten
thousand (10,000) inhabitants in the jurisdiction in excess of
thirty thousand (30,000) and for such additional branch reg-
istration places as the commissioner deems necessary. Any
petition mentioned in this section must be received by the
commissioner not later than the fifteenth day of August pre-
ceding any general electicn. The commissioner shall designate
the location of the branch registration places not later than
the first day of September following the receipt of a petition.
(h) All branch registration places shall be opened the first
Monday in October preceding any general election, and shall
remain open Monday through Friday from 12:00 noon Until
8:00 p.m., and Saturday from 8:00 a.m. until 5:00 p.m. for one
(1) week.
(i) The commissioner of registration shall appoint two (2)
persons to act as deputy registrars in each branch registration

place. The appointments shall be made from lists supplied for
that purpose by the official county chairman of the two (2)
political parties polling the highest vote in the jurisdiction at
the last preceding general election. Such lists shall be provided
not later than the fifteenth day of August preceding the ap-
pointments. The commissioner shall appoint one (1) deputy
• from each list for each branch. Such appointments shall be

made not later than the fifteenth day of September following
the receipt of the lists. Where the county chairmen fail to
provide lists by the date specified in this section, the commis-
sioner shall make such appointments to persons known to be
registered as members of the appropriate political party. (Rev.

Sec. 10-131. Mobile deputy registrars: Appointment; author-
ity; identification; compensation.
(a) The commissioner of registration shall appoint at least
six (6) persons for each ten thousand (10,000) inhabitants, or
major fraction thereof, within his jurisdiction as mobile dep-
uty registrars. An equal number of these appointees shall
be appointed from lists supplied for that purpose from the
county chairmen of the two (2) political parties polling the
highest vote in the jurisdiction in the last preceding general
election. The list of appointees as submitted to the commis-
sioner of registration shall be made available to the party
chairmen of the two (2) parties receiving the highest votes
• at the preceding election for secretary of state.

(b) Mobile deputy registrars are authorized to secure reg-
istration of eligible voters anywhere in the jurisdiction of
the commissioner of registration and shall make such reports
of new registrations and changes as the commissioner of
registration requests and shall take an oath of office admin-
istered by the commissioner of registration.
(c) Mobile deputy registrars shall be appointed before the
first of August preceding any general election and the ap-
pointments shall expire when registration closes for that elec-
tion. Mobile deputy registrars shall serve without compensa-
tion from any source.

(d) The commissioner of registration shall furnish to each
mobile deputy registrar proper registration forms which shall
be numbered and accounted for by the mobile deputy registrar
to the commissioner of registration. There shall be provided
on said form a space for the signature of the mobile deputy
registrar who shall sign same and identify himself with ap-
propriate identity papers or badge provided by the commis-
sioner sioner of registration in the piesence of the voter and a copy
of said voter registration form shall be given to the voter as
a receipt of the fact that he is duly registered. The mobile
deputy registrar shall be a person of known good character
who has reached the age of majority and who is familiar with
the registration laws of the state and shall be trained by the
commissioner of registration in a manner he deems adequate.
It shall be unlawful for any mobile deputy registrar or any
registrar to refuse to register any eligible voter and any such
refusal is a criminal offense punishable as provided by law.
The mobile deputy registrar must be a resident of the county
wherein he is appointed. It shall be the duty of the secretary
of state to designate a suitable voter registration form for
the purpose of this section. A list of the persons registered
under this section shall be made available weekly to the county
chairman of each of the two (2) major political parties for

Sec. 10-132. Training sessions for deputy registrars; attend-
ance or other qualifications required.
Before the first day of August preceding any general elec-
tion, the commissioner of registration shall hold at least one
(1) training session for mobile deputy registrars. Before the
first day of October preceding any general election, the com-
missioner of registration shall hold at least one (1) training
session for the deputy registrars who will serve at branch
registration places. No person shall qualify as either a mobile
or branch deputy registrar unless he attends at least one (1)

such training session during the year in which he is to serve,
or is otherwise determined by the commissioner to be quali-

Sec. 10-133. Compensation of deputy registrars.
Deputy registrars shall serve without pay. (Rev. Ord. No.
2371, § 16, Comp. 1941, p. R-6)
Sec. 10-134. Closing of election register; time during which
voters may not be registered.
The commissioner of registration shall have nine (9) full
days between the last day of registration, and election day
to perfect his election registers and, for that purpose, nine
(9) days before any election day shall be days upon which
voters may not register. During these nine (9) days, the com-
missioner shall complete the election registers and, on the
day before election day, he shall deliver them as required by
law to each election precinct. (Rev. Ord. No. 2371, § 18, Comp.

Sec. 10-135. Challenges by individuals: Procedure; determina-
tion; appeal.
Any person may challenge a registration at any time by
filing a written challenge with the commission of registra-
tion. The commissioner of registration shall immediately give
five (5) days' notice of a hearing by registered or certified
mail to the challenger and the person challenged. If the per-
son challenged fails to appear, his name shall be removed from
the registration list. However, if the person challenged notifies
the commissioner prior to the date set for the hearing that he
is unable to appear on the date specified, the commissioner
may reschedule the hearing. At such hearing the commission-
er shall hear such evidence as he deems to have probative
value. The person challenged shall be required to sign an affi-
davit as provided in section 10-128, and may then be ques-
tioned concerning his voting residence and qualifications. In

all cases the commissioner shall decide the right to the entry
of registration under the evidence. Either party may appeal
to the district court of the county, and a date for the hearing
shall be fixed, and the decision of such court shall be final.
