Enclosed in this packet are (1) the Auditor's planning worksheet (2) nomination papers (3) affidavits of candidacy (4) candidate guide and (5) Iowa Ethics & Campaign Disclosure Guides for municipal candidates. Any of these items may be reproduced if your supply is not sufficient. Please review the enclosed nomination worksheet to see that it gives the proper number and designation of seats to be voted for in your municipality on November 4th. This form DOES NOT mention public measures that some of you indicated MAY or WILL be placed on your ballot. Remember that public measures must be delivered to the Election Office by the same deadline as your nomination papers, Friday, September 19, 1997, at 5:00 o'clock p.m. (except Gilbertville, 8/28/97). Any vacancies that occur on or before September 13th, 1997, must be filled at the November 4th election. Please inform me as soon as possible if this circumstance should occur. Also, the specific wording of any public measure must be presented by the same deadline specified for nomination papers. LEAVE YOUR MARK ON AMERICA... VOTE June 17, 1997 Page 2 Nomination papers with their attached affidavit of candidacy and public measure questions should be accompanied by your letter which lists, legibly, all offices to be placed on the ballot and the names of candidates who are filing. Signatures required for nomination are determined by the nomination process chosen in each municipality. An outline of cities in Black Hawk County and their required MINIMUM number of signatures is enclosed. Our office recommends additional signatures be sought to minimize any challenges. Nomination papers must be complete, indicating the name of the city, ward or at-large race, the name of the candidate (without titles) as he or she wishes to have it appear on the ballot, the candidate's complete address and the date of election, November 4, 1997. If candidates are considering to run as a non-party political organization (as referenced on the nomination paper heading) each candidate wishing to be a part of that organization must agree on their organizational name and include it on each nomination paper. All candidates must complete and sign one copy of the affidavit of candidacy form, their name must be identical on both nomination petitions and affidavit. The affidavit form requires notarization. The petition and affidavit of candidacy form for each candidate MUST BE BOUND OR STAPLED INTO A SINGLE GROUP OF PAPERS. With the beginning of the 1997 election year we request that you check your supplies and contact us if you need additional forms. The forms should be filled out completely by the applicant, and you are encouraged to review the information for completeness and legibility. Routinely and without delay voter registration forms accepted by you from the applicant should be mailed to the Election Office. It is permissible for the applicant to mail the form to the Election Office themselves, however, they should be made aware of any known registration deadlines for upcoming elections. INSTRUCTIONS: 1. OFFICE. List all offices that are filled by election, even if the term ends in two years. Examples of offices to include are city council member and mayor. DO NOT list any offices that are filled only by appointment (e.g.: city clerk and treasurer). 2. TERM. In column 2 put the number of years (2 or 4) a person elected to a full term would serve for each office listed in column 1. 3. DATE TERM ENDS. In column 3 indicate the date the term expires. If the incumbent was elected or appointed to fill a vacancy, use the expiration date of the term the last time a person was elected to the seat for a full term. 4. NAME OF INCUMBENT. City Election ...��,-- W Secretary of State '��i��'"r r November 4, 1997 s yP State of Iowa aRY OF For Candidates Seeking Nomination By Convention WHERE TO GET NOMINATION PAPERS - Call, write or visit: City Clerk or County Auditor's Office QUALIFICATIONS - Candidates for election to city offices must be eligible electors of the city. An eligible elector is a person who meets all of the qualifications to register to vote whether or not the person is registered. Candidates who are seeking election from wards must be residents of the ward at the time the nomination certificate is filed and at the time of the election. NOMINATIONS - There are three methods of getting one's name on the ballot for city elections. Ask your City Clerk or County Auditor which of the following applies to your city: (1) For cities with nominations under Chapter 44 (by convention) Nominations are made by a convention attended by at least ten (10)eligible electors, including at least one eligible elector from one-half of the voting precincts in the city. NOTE:In Chapter 44 cities there is no primary or runoff election. (2) For cities with nominations under Chapter 45 (by petition) Candidates are nominated by petition. The minimum number of signatures is based on the population of the city: Population of the City Signatures Required Less than 100 5 100 or more, but less than 3,500 10 3,500 or more 25 NOTE:In Chapter 45 cities there is no primary or runoff election. (3) For cities with Primary Elections gr Runoff Provisions (by petition) Candidates are nominated by petition. Each petition must include a number of signatures equal to at least 2% of the number of people who voted to fill the same office at the last regular election, but not less than 10. No city will have both a primary and a runoff election. NOTE: A separate guide is available for candidates who will be nominated by petition. CHECKLIST FOR NOMINATION PETITIONS 1. The Convention: ❑ CHECK ATTENDANCE. Be sure that enough people present to meet the minimum requirements of the law: A. At least one eligible elector from half the voting precincts in the city. Check with the County Auditor or the City Clerk for this number. Monday, CANVASS OF VOTES November 10 Canvass by the Board of Supervisors. (Some canvasses may be held on Wednesday, November 12.) Tuesday, VETERAN'S DAY-HOLIDAY November 11 Thursday, RECOUNT REQUEST DEADLINE November 13 Written request for a recount must be filed in the Office of the County Auditor by 5 p.m. (If the canvass was held on November 12, the recount request deadline is November 17.) Friday, CONTEST NOTICE DEADLINE November 14 Statement of intent to contest election must be filed with the City Clerk no later than ten days after the election. ❑ NOTARY REQUIRED. A notary public must be present when the candidate signs the affidavit. The notary must also sign the Affidavit by Candidate and include the official title - Notary Public. Other officers who may legally witness oaths may substitute for a notary. CANDIDATE'S SIGNATURE. The spelling of the name, including initials, should be exactly the same as the spelling of the name on the nomination petitions and as printed on the affidavit. The candidate must sign the affidavit in front of a notary public, or other officer who is empowered to witness oaths. 4. Getting ready to file: ❑ BE SURE YOU ARE READY. Once the nomination papers have been accepted for filing nothing can be added to them and they cannot be returned to the candidate.. 5. Williams : In light of a decision by the Eighth Circuit Court of Appeals , you have requested an opinion on the constitutionality of a state law prohibiting the placement of political signs on property adjoining a public roadway no sooner than forty-five days before an election and requiring their removal no later than seven days after an election. The Court in Whitton v . City of Gladstone, 54 F . 3d 1400, 1403-09 ( 8th Cir. 1995 ) , held that a city ordinance prohibiting the placement of political signs . on property no sooner than thirty days before an election and requiring their removal no later than seven days after the election violated the First Amendment to the United States Constitution . The Iowa Ethics and Campaign Disclosure Board has noted the "relatively close" similarity between the city ordinance examined in Whitton v . City of Gladstone and the state law, Iowa Code Ms . Kay Williams Page 2 section 56 . 14 ( 2 ) (a ) ( 1997 ) . It has , therefore, suspended administrative enforcement of section 56 . 14 ( 2 ) (a ) until receipt of this opinion . We agree that Whitton v. City of Gladstone leads to the conclusion that section 56 . 14 ( 2 ) (a ) offends the federal constitutional guarantee of free speech to the extent it limits the time political signs may be placed on property adjoining a public roadway. I . Chapter 56 governs political campaigns . Section 56 . 14 ( 2 ) (a) limits the period of time that "yard signs " may be placed on property adjoining public roadways . It provides in part : Yard signs shall not be placed on any property which adjoins a city, county, or state roadway sooner than forty-five days preceding a primary or general election and shall be removed within seven days after the primary or general election, in which the name of the particular candidate or ballot issue described on the yard sign appears on the ballot . See generally Iowa Code § 4 . 1 ( 30 ) (a ) (word "shall" in statutes normally imposes a duty). The Iowa Ethics and Campaign Disclosure Board, charged with administering chapter 56 , has promulgated a rule construing "yard signs " to mean "political signs " having certain dimensions . 351 IAC 4 . 5 (5 ) . See generally Iowa Code § 4 . 1 ( 38 ) (words and phrases in statutes shall be construed according to context) , § 4 . 6 ( 6 ) ( statutory construction may take into account administrative construction of statute) . II . In Whitton v. City of Gladstone, the Court of Appeals for this circuit considered a city ordinance prohibiting the placement on property of political signs no sooner than thirty days before an election and requiring their removal no later than seven days after the election. See 54 F . 3d at 1402 n. 2 . The city argued that these durational limitations did not regulate free speech on the basis of its content and that they did not unreasonably restrict free speech in view of the city' s strong interests in maintaining its appearance and promoting traffic safety. Id . at 1403 . The Court noted that signs pose distinct problems for city regulation, because, among other things , they may obstruct views or a Ms . Kay Williams Page 3 distract motorists . Id . at 1402-03 . The Court added, however, that the First Amendment protects signs as a form of free speech and "has its fullest and most urgent application to speech uttered during a campaign for political office . " Id. at 1402-03 . The Court determined that the ordinance directed toward political signs amounted to a "content-based restriction, " because "it makes impermissible distinctions based solely on the content or message conveyed by the sign. " Id. at 1404 . In supporting this determination, the Court also noted that the ordinance granted certain forms of commercial speech a greater degree of protection than political speech . Id. at 1404-05 . Such commercial speech -- which included construction, advertising, and real-estate signs -- did not have the durational limitations imposed upon political signs . Id. A content-based restriction implicates the most exacting level of judicial review commonly known as "strict scrutiny. " Id. at 1408 . According to the United States Supreme Court, "it is the rare case in which . . . a law survives strict scrutiny. " Burson v . Freeman, 504 U. S . 191 , 211 , 112 S . Ct. 1846 , 119 L. Ed . 2d 5 ( 1992 ) . Accord Whitton v. City of Gladstone, 54 F. 3d at 1408 . "With rare exceptions, content discrimination in regulations of speech of private citizens on private property or in a traditional public forum is presumptively impermissible, and this presumption is a very strong one. " City of Ladue v. Gilleo, 512 U.S . , 114 S . Ct. 2038 , 129 L. Ed. 2d 36 , 50 ( 1994 ) (O'Connor, J. , concurring) . Accord Whitton v. City of Gladstone, 54 F. 3d at 1408 . To survive strict scrutiny, content-based restrictions must serve a "compelling governmental interest" and must represent "the least restrictive alternative" available. Whitton v. City of Gladstone, 54 F. 3d at 1408 . Applying these principles to the city ordinance under consideration, the Court in Whitton v. City of Gladstone determined that the durational limitations neither served a compelling governmental interest nor represented the least restrictive alternative available to the city. Id . at 1408-09 . First, a city' s interests in its aesthetic appearance and traffic safety, "while significant, have never been held to be• compelling. " Id . at 1408 . Second, other ordinances regulating political signs within the city adequately furthered these interests . Id. Third, the city failed to present sufficient evidence that political signs required treatment different from that it had afforded other types of signs . Id . In view of these three factors, the Court held that the city ordinance' s durational limitations unconstitutionally restrained free speech . Id . at 1409 . Ms . Kay Williams Page 4 we do not perceive any significant difference between the durational limitations in the city ordinance under consideration in Whitton v. City of Gladstone and those limitations in section 56 . 14 ( 2 ) (a) . Compare Whitton v. City of Gladstone, 54 F . 3d at 1402 n . 2 ( city ordinance: political signs may be placed on property not sooner than thirty days before election and must be removed no later than seven days after election) with Iowa Code § 56 . 14 ( 2 ) (a ) (yard signs , administratively construed to mean political signs , 351 IAC 4 . 5 ( 5 ) , may be placed on any property adjoining public roadway not sooner than forty-five days before election and must be removed no later than seven days after election) . We also do not perceive any governmental interests underlying sections 56 . 14 ( 2 ) (a ) , not advanced by the city in Whitton v. City of Gladstone, which could be considered compelling in nature. See generally 7 E. McQuillin, The Law of Municipal Corporations S§ 24 . 380- . 384 . 50 ( 1989 ) . Moreover, we note that section 56 . 14 ( 2 ) (b) permits the placement of a political sign on certain designated properties without imposing any time limitations at all . Under such circumstances , we must conclude that the time limitations in section 56 . 14 ( 2 ) (a ) offend the First Amendment as interpreted by the Court in Whitton v. City of Gladstone . We make one final comment. You mention that the Iowa Ethics and Campaign Disclosure Board has suspended administrative. enforcement of section 56 . 14 ( 2 ) (a) . Given the "relatively close" similarity between the city ordinance examined in Whitton v. City of Gladstone and section 56 . 14 ( 2 ) (a ) , we believe that this administrative action appears proper. See 1984 Op. Att 'y Gen. 66 , 69 (under unusual and limited circumstances involving a recent decision by the United States Supreme Court on a statute essentially similar to one in Iowa, state agency charged with enforcing the Iowa statute should proceed in accordance with that decision ) ; see also Iowa Auto Dealers Ass 'n v. Iowa State Appeal Bd . , 420 N.W. 2d 460 , 461-62 ( Iowa 1988 ) . III .
