RESOLUTION FIXING THE TIME AND PLACE OF
HEARING TO BE GIVEN ON APPLICATION OF MKW
APARTMENTS LLC TO REZONE FROM "R-3" MULTIPLE
RESIDENCE DISTRICT TO "R-4" MULTIPLE
RESIDENCE DISTRICT APPROXIMATELY 7 ACRES
GENERALLY LOCATED ALONG CATARACT AVENUE AND
EDGEMONT AVENUE, JUST SOUTH OF RIDGEWAY
AVENUE AND WEST HIGH SCHOOL, AS FEBRUARY 12,
2007, AT 5 : 30 P.M. IN THE COUNCIL CHAMBERS IN
CITY HALL AND INSTRUCTING CITY CLERK TO
PUBLISH NOTICE OF HEARING.
WHEREAS, the Council of the City of Waterloo, Iowa, shall
meet in the Council Chambers in the City Hall in the City of
Waterloo, Iowa, at 5 : 30 p.m. on the 12th day of February, 2007,
for the purpose of considering and acting upon an application of
MKW Apartments LLC to rezone from "R-3" Multiple Residence
District to "R-4" Multiple Residence District approximately 7
acres generally located along Cataract Avenue and Edgemont
Avenue, just south of Ridgeway Avenue and West High School and
legally described as follows :
Parcel "A" of Plat of Survey Doc. #2005-09648, being a
part of the West Fractional Half of the Northwest
Fractional Quarter of Section 3, Township 88 North,
Range 13 West of the Fifth Principal Meridian in the
City of Waterloo, Black Hawk County, State of Iowa,
described as follows :
Commencing at a point on the Southerly line of Ridgeway
Avenue which is 115. 45 feet West of the East line of
the West Fractional Half of the Northwest Quarter of
said Section 3, which is also the Northwest Corner of
Lot 181, Crestview Second Addition; thence South along
the West line of Crestview Second Addition 260 feet to
the intersection with the South line of Cataract Avenue
and the point of beginning; thence South 00°00' 00" East
336. 35 feet along the West line of Crestview Second
Addition to a clip pipe found; thence continuing South
00°04' 16" West 230 . 20 feet along the West line of
Crestview Second Addition; thence South 89°57100" West
413 . 60 feet to a point on the East line of Edgemont
Avenue; thence North 00°06153" West 566. 54 feet along
the East line of said Edgemont Avenue to the
intersection with the South line of said Cataract
Avenue; thence North 89°56' 57" East 415 . 03 feet along
said South line of Cataract Avenue to the point of
beginning, all in the City of Waterloo, Black Hawk
County, Iowa .
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the City Clerk is hereby directed to publish
Notice of the time and place of said hearing in the Waterloo
Courier.
