RESOLUTION NO. 2007-2
RESOLUTION GRANTING PERMISSION TO JERALD
QUINT FOR A WAIVER FOR A CONCRETE DRIVEWAY TO
BE LOCATED AT 5640 KIMBALL AVENUE, AND
AUTHORIZING CONSTRUCTION OF A CONCRETE
DRIVEWAY WITH ELIMINATION OF THE SIDEWALK
SECTION DUE TO THE INABILITY TO MEET
REQUIREMENTS OF THE DRIVEWAY AND SIDEWALK
POLICY, PARAGRAPH 1 .
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
WHEREAS, the City Engineer has made written application to
the City Council asking that Jerald Quint be authorized and
permitted to construct a concrete driveway and authorizing
construction of a concrete driveway with elimination of the
sidewalk section due to the inability to meet requirements of the
driveway and sidewalk policy, paragraph 1 to be located at 5640
Kimball Avenue, and legally described as follows :
That part of the North ',i of the Southeast Quarter (N'-�
SE34) of Section No. 16, Township No. 88 North, Range
No. 13 West of the Fifth Principal Meridian, Black Hawk
County, Iowa, described as follows :
Commencing at the Southeast corner of the Southeast
Quarter of said Section No. 16, point being a found 3"
aluminum disc in P.C.C. pavement, thence due North
along the east line of the Southeast Quarter of said
Section No. 16 a distance of 1, 325. 76 feet to the
Southeast corner of said North Half of the Southeast
Quarter, thence South 89°12115" West along the South
line of said North Half of the Southeast Quarter a
distance of 40 . 0 feet to the Westerly right-of-way line
of Kimball Avenue, being the point of beginning and a
set of &�" rebar with license #6505, thence continuing
South 89012115" West along said South line a distance
of 484 . 0 feet to a set 'W" rebar with license #6505,
thence North 00020' East a distance of 629. 58 feet to a
set of '-�" rebar with license #6505, thence South 89046'
45" East a distance of 480 . 3 feet to the said Westerly
right-of-way line of Kimball Avenue, thence due South
along said Westerly right-of-way line a distance of
238 . 02 feet to a set '-�" rebar with license #6505,
thence North 89°12' 15" East along said Westerly right-
of-way line a distance of 7 . 0 feet to a set of '-�" rebar
with license #6505, thence due South along said
Westerly right-of-way line a distance of 158 . 95 feet to
a set of '- " rebar with license #6505, thence South
89012' 15" West along said Westerly right-of-way line a
distance of 7 . 0 feet to a set ;i�" rebar with license
#6505, thence due South along said Westerly right-of-
way line a distance of 224 . 02 feet to the point of
beginning, all in the City of Waterloo, Black Hawk
County, Iowa.
Contains 6. 95 acres.
Subject to easements of record and not of record.
Note: The East line of said Southeast Quarter of said
Section No. 16 is assumed to bear due North for this
description;

and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Jerald Quint to construct a concrete driveway
subject to the following conditions :
1 . Work to be performed by an approved and bonded
contractor.
2 . A permit is to be obtained from the office of the City
Engineer prior to construction.
3. All work shall be performed under the supervision of
the City Engineer and at no cost to the City of
Waterloo.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk County
Auditor for filing in order that this said action may become a
matter of official County Record.
