Dear Sir:
Section 5634 of the Code provides that
a Health Physician shall be appointed by the Mayor.
Section 1054 provides the oath that must be
subscribed to by all public Officers , and Section 1059 gives the
form of bond that must be signed .
Section 1068 provides that the Council shall fix
the amount of the bond , and Section 1070 provides tat it shall
have at least two sureties unless given by a Bonding Company.
The bond when given must be approved by the Council.
I therefore think that the Mayor had the
authority to appoint Dr. Thompson dealth Physician , and
Dr. Thompson should qualify by giving bond in such amount as
the Council may deem proper and by taking the oath prescribed
by the Code .
