This Resolution prepared by Nancy Eckert, City Clerk, 715 Mulberry Street, Waterloo, Iowa. RESOLUTION NO. 2006-1057 RESOLUTION ACCEPTING AND APPROVING ACQUISITION OF PROPERTY GENERALLY LOCATED AT 447-449 CHERRY STREET IN THE CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA. WHEREAS, Iowa Code Section 657A. 10A allows cities to petition the courts for possession of vacant and dilapidated homes, of which no one will take responsibility for its condition, and WHEREAS, the hereinafter described parcel contains a vacant dwelling that has been deemed dangerous and unsafe by the Building Official, and WHEREAS, it is the intention of the City of Waterloo to demolish the dangerous building immediately, and WHEREAS, after said demolition, the City of Waterloo will be able to offer the property to the adjacent property owners or interested parties for a reasonable cost, and WHEREAS, the Iowa District Court for Black Hawk County found that proper Notice of Intent to Take Default against several parties was properly mailed, and WHEREAS, the Iowa District Court for Black Hawk County found: 1 . That 447-449 Cherry Street, legally described as follows : The South 54 feet to the East 44 feet of Lot No. 6 and the South 42 feet of the West 36 feet of Lot No. 6 in `Smith' s Subdivision" in the City of Waterloo, Black Hawk County, Iowa; is a residence located in Waterloo, Black Hawk County, Iowa. That the taxes on said property were not being paid and the property was sold at a tax sale, with HLS US Bank the tax lien purchaser in 2003 . There are no utilities being provided to the property. The property is unoccupied and has been vacant for a number of years . The property does not meet the City of Waterloo' s Housing Code for being fit for human habitation or occupancy. There is debris accumulating around the house and the condition of the house allows vermin to move freely in and out . The roof has holes in it and there is extensive damage to the house . There is a large presence of accumulation of debris and uncut vegetation. 2 . That because of the findings of fact made by the Iowa District Court of Black Hawk County, it was determined that the property is an abandoned building pursuant to Section 657A. 10A. (4ution No. 2006-1057 e=: 2 WHEREAS, the Iowa District Court of Black Hawk County ©rBared, adjudged and decreed that the above described property sJ3n abandoned property pursuant to Section 657A. 10A and M, marled title of said property to the City of Waterloo, and 7 sq t5v NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCI CSF,TIE CITY OF WATERLOO, IOWA, that the above described property saccepted and approved for the purposes as described in sect-on 657A. 10A.
