Dear City Clerk:
Your city is among those in Black Hawk County that have elected
to accept nominations for municipal elections under the provisions
of Chapters 44/45, Code of Iowa.
Under Chapter 44, candidates are allowed to appear on the muni-
cipal ballot under a Nonparty Political Organization. This
requires that a convention or caucus be held by such organization,
and at this convention or caucus there must be in attendance a
minimum of 10 eligible electors who are residents of the city,
including at least one eligible elector from at least one-half
of the voting precincts in that city.
Candidates going this route need to complete a Certificate of
Nomination by Convention or Caucus (153-D) . A sample is enclosed
to show how these are to be filled out. It must be notarized.
Candidates not wishing to file through a nonparty political or-
ganization would file under the provisions of Chapter 45 . Using
the Nomination Paper - By Petition form (Form 59) , the candidate
must get a minimum of twenty-five (25) signatures of eligible
electors who live in the district served by the office they seek.
Each form must be notarized.
Each candidate, regardless of the method of nomination, must
complete an Affidavit of Candidacy form (159-P2) . This must
also be notarized, and on this as well as all other forms, the
candidate' s name should appear as it is to appear on the ballot.
Only one affidavit is required per candidate.
The first date to file nomination papers for the November 8
election is September 6. The papers must be filed in your office.
The last day to file is September 29, by 5 : 00 pm. Then, you
must file the papers at our office by 5: 00 pm, September 30.
If you wish, you may file them here prior to that date, as you
receive them.
Any propositions to appear on your ballot must accompany the
nomination papers by the cutoff date. Questions that would be

Dear Mr. Veeder:
At your request I have researched the issue of any residential
requirements, if any, for persons who are candidates for at-large
seats on the City Council.
Chapter 2-1.1(e) of the Waterloo Code specifies that the Council
shall consist of two councilmen elected at large. There is nothing
in the Waterloo Code that specifies that these candidates be from
either the West or East areas of the City. Furthermore, I have
been unable to find any boundaries that define East-at-large or
West-at-large within the City.

Chapter 372.4, Code of Iowa (1983), reflects the same provisions
as our Waterloo Code with regard to at-large seats and Chapter
376.4, Code of Iowa (1983), merely requires that the individuals
seeking election for City Council be a resident of the Ward at
the time of the filing of the nominating petition and at the time
of the election. Upon reading these two relevant portions of
the Code of Iowa, it is my opinion that the individuals who are
campaigning for an at-large seat on the Council must merely be
residents of the City. There has been no case law specifying
residency within a particular area of a city for an at-large seat.
Therefore, it is my opinion that the only requirement of residency
for an at-large candidate is that the candidate reside within
the City of Waterloo at the time of the filing of the nominating
petition and at the time of the election. It would appear that
the at-large seats are to be filled by persons who will represent
the community at large, rather than representing citizens from
a particular ward within the city.
