Remove slab and footings as non -asbestos containing material and haul away. 3 . ) Landfill fees included in bid price . 4. ) Backfill basement with suitable fill . 5 .) Proper containment of asbestos containing building demolition area . 6.) Proper wrapping and containment of trucks to haul asbestos containing debris to state approved landfill . 7. ) Keep asbestos containing material thoroughly wet throughout removal, loading, and disposal procedures. 8.) Abide by all NESHAP and OSHA regulations when dealing with the removal of asbestos containing material . 9 .) All workers with be equipped with the proper PPE; respirators, Tyvek suits, etc. 10. ) Proper disconnects of sewer and water. 11. ) Proper disconnects of gas and electric. 12 .) Obtain all required state and local permits. ASSUMPTIONS - This Proposal is subject to and provided based upon the following assumptions: 1 . ) Property to the east of building to be demolished will be available for IA Demolition throughout demolition procedures for staging and loading. AF— EXCLUSIONSd provided based upon 1 . ) Remove or manage the removal of items identified to be hazardous materials by any governmental agency. In the event Contractor encounters hazardous materials, Contractor may, at its sole discretion, discontinue work on the site . Contractor will promptly notify General Contractor of the identification of hazardous materials. In the event work by Contractor is delayed, Contractor shall be entitled to an increase in the contract price for additional mobilization to the site . In the event the delay due to hazardous materials exceeds 30 days, Contractor shall be entitled to payment for work performed from the commencement of the project to the time work is suspended. 2 . ) Be responsible for any asbestos surveys . 3 . ) Be responsible for any third party oversite. 4. ) Be responsible for any backfill, compaction, or seeding. 5. ) Be responsible for any testing. 6. ) Be responsible for any site security fencing or temporary fencing. 7 .) Be responsible for any soil erosion prevention plan or execution thereof. 8. ) Be responsible for any utility disconnections not stated in the scope of work. 9. ) Be responsible for any damaged paving from normal demolition activity. 10. ) Be responsible for the removal of debris below grade without the negotiation of a change order to the quote contained herein . Owner's obligation to pay ESA under this agreement maybe secured by a general mechanics' lien. Interest shall accrue on all overdue balances at the rate of 1.5% per month. In the event payment is not made as required herein, ESA shall be entitled to recover all costs of collection, including, but not limited to, reasonable attorney fees. Retainage, if any, shall be paid within thirty (30) days of completion of the Scope of Work as defined above. Owner and ESA may agree to changes in the scope of Work. Any modifications to the Scope of Work shall be approved by both Parties. Change orders made pursuant to this provision shall be incorporated herein and become part of this agreement. ESA's ability to perform In accordance with this agreement is subject to and contingent upon strikes, accidents, or delays beyond our control. Owner shall carry fire, tornado, or other necessary loss insurance. ESA is not the generator of waste, Owner is the generator of waste and hereby gives ESA authority to sign waste disposal documents on Owner's behalf.
