The undersigned, being first duly sworn on oath, deposes and states as follows:
That AKE, LLC is now the record titleholder of the following described real estate situated in Black
Hawk County, Iowa:
That part of the East One-half of the Southeast Quarter of Section No. 2, Township 89
North, Range 13 West of the Fifth Principal Meridian in Black Hawk County, Iowa described
as follows: Beginning at a point that is 883.51 feet North and 33 feet West of the Southeast
corner of said Section; thence South 89°06'59"West a distance of 297 feet; thence South
00°04'16" East parallel with the East line of said Section a distance of 90 feet; thence North
89°06'59" East a distance of 297 feet; thence North 00°04'16"West a distance of 90 feet to
the point of beginning. Except that part conveyed to the State of Iowa for road purposes in
548 LD 713.
That AKE, LLC is now in complete actual and sole possession of all of said real estate except as
may be herein stated. That this affidavit is made from the personal knowledge of the undersigned,
who is familiar with said real estate, its titleholders, and its parties in possession; and that this affidavit
is for the purpose of confirming title to the above-described real estate under the provisions of Sections
614.17 and 614.17A, Code of Iowa, and other statutes relative thereto.

which Addison Ewoldt and Kristin Ewoldt were grantors and AKE, LLC was
grantee. Said deed failed to cite the marital status of the grantors. The
grantors are husband and wife.
2. This affidavit is given to clarify title to real estate legally described as:
