RESOLUTION NO. 2016-151
RESOLUTION APPROVING A DEVELOPMENT AGREEMENT
WITH AMERICAN PATTERN STORAGE, LLC TO
AUTHORIZE THE SALE AND CONVEYANCE OF CITY-
OWNED LAND FOR $1 . 00, OF THE FORMER FOOD BANK
SITE AT 106-116 EAST 11TH STREET, TO ALLOW
FOR THE REDEVELOPMENT OF THE SITE INTO
INDUSTRIAL AND, MANUFACTURING SPACE, WITH A
NEW TAXABLE VALUE OF $576, 000, AND
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE NECESSARY DOCUMENTS.
WHEREAS, the City of Waterloo, Iowa intends to enter into a
Development Agreement with American Pattern Storage, LLC, of
Waterloo, Iowa on March 7, 2016 for the sale and conveyance of
city-owned land of the former Food Bank site at 106-116 East 11th
Street, to allow for the redevelopment of the site into
industrial and manufacturing space, with a new taxable value of
$576, 000, and
WHEREAS, the City of Waterloo, Iowa, is the owner of real
property in the City of Waterloo, Iowa, as described below, and
WHEREAS, an offer to purchase said certain real property in
the sum of $1 . 00 has been made by American Pattern Storage, LLC,
and
WHEREAS, a public hearing was held on March 7, 2016, at 5 : 30
p.m. in the Harold E. Getty Council Chambers, City Hall,
Waterloo, Iowa, as provided by law, by the Council of the City of
Waterloo, Iowa on the proposal to sell and convey premises owned
by the City of Waterloo, Iowa, to American Pattern Storage, LLC,
and
WHEREAS, it is the opinion of this Council that sale and
conveyance should be made as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS:
1 . The following described real property, as fully
described in the published notice in the Waterloo Courier on
February 22, 2016, is not presently needed and will not be needed
in the foreseeable future for municipal purposes and its
ownership is serving no municipal purpose, and
2 . That the offer by American Pattern Storage, LLC to
purchase real property for the sum of $1 . 00, be and it is hereby
accepted for real Property described as follows :
AUDITORS CONSOLIDATED PLAT LOT 3 NORTH 27 . 5 FEET LOT 7 ALL
LOT 8 EXCEPT THAT PART LOTS 3 & 8 BEGINNING AT MOST
NORTHERLY CORNER LOT 3 SAID PLAT THENCE SOUTH 48 DEGREES 19
MINUTES 24 SECONDS EAST ALONG NORTHEASTERLY LINE SAID LOT 3
111. 60 FEET THENCE SOUTH 42 DEGREES WEST 290 . 33 FEET THENCE
NORTH 48 DEGREES WEST 111 . 60 FEET TO NORTHWEASTERLY LINE
SAID LOT 3 THENCE NORTH 42 DEGREES EAST ALONG SAID
NORTHWESTERLY LINE 289 . 70 FEET TO POINT OFw BEGINNING, CITY
OF WATERLOO, BLACK HAWK- COUNTY, STATE OF IOWA.
3 . That the City of Waterloo, Iowa conveys said parcel of

real property to American Pattern Storage, LLC by deed.
4 . That Mayor and City Clerk are hereby authorized to
execute said deed to American Pattern Storage, LLC.
5 . That the original of said deed fully executed and
acknowledged is hereby approved and confirmed by the Council .
6. That the Planning and Zoning Department is authorized
and directed to deliver said deed of conveyance to American
Pattern Storage, LLC.
7 . That a Development Agreement dated March 7, 2016 between
American Pattern Storage, LLC, of Waterloo, Iowa and the City of
Waterloo, Iowa for the sale and conveyance of city-owned land of
located 106-116 East 11th Street, to allow for the redevelopment
of the site into industrial and manufacturing space, with a new
taxable value of $576, 000, is hereby approved and confirmed by
the Council .
