RESOLUTION NO. 2021-135
RESOLUTION APPROVING AN ENCROACHMENT
AGREEMENT WITH NORTHERN NATURAL GAS
COMPANY, IN CONJUNCTION WITH THE FY 2021 E.
SHAULIS ROAD TRAIL EXTENSION PROJECT, CONTRACT
NO. 1012, AND AUTHORIZING THE MAYOR TO EXECUTE
SAID DOCUMENT.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, that
the request of Northern Natural Gas Company for an Encroachment Agreement, dated March 1,
2021, by and between Northern Natural Gas Company and the City of Waterloo, Iowa, in
conjunction with the FY 2021 E. Shaulis Road Trail Extension Project, Contract No. 1012, for
encroachment upon a portion of Northern Natural Gas Companies easement and in close
proximity to Northern's pipeline facilities, and legally described as follows:
Lot 27 in Triangle Terrace, Black Hawk County, Iowa (now in the City of
Waterloo, Iowa), subject to restrictions and easements of record, excepting
tberetroxn the following two tracts: (a) Commencing at the Northeast corner
of Lot 26 in said Triangle Terrace; thence West along the North line of said
Lot 26 a distance of 181.5 feet; thence North along a line parallel with the East
line of said Lot 27 a distance of 120 feet; thence East along a line parallel with
the North line of said Lot 26 a distance of 181,5 feet to the East line of said
Lot 27; thence South to the point of beginning; (b) Commencing at a point on
the East line of said Lot 27 that is 240 feet North of the Northeast corner of
said Lot 26; thence West along a line parallel with the North line of said Lot
26 a distance of 181.5 feet; thence North along a line parallel with the East line
of said Lot 27 a distance of 120 feet; thence East along a line parallel with the
North line of said Lot 26 a distance of 181.5 feet to the East line of said Lot
27; thence South 120 feet to the point of beginning.
is hereby approved and the Mayor is authorized and directed to execute said document on behalf
of the City of Waterloo.
