June 5, 1972 . Mayor Turner in the Chair. Present : Councilmen Cavanaugh, Cohea, Dykeman, Mabrey , Miller and Morrissey . Absent , Councilman Keller. Councilman Glenda Mabrey offered the invocation. 62211 - Moved by Cohea, seconded by Morrissey that the Agenda , as amended, for the Regular Session cf June 5, 1972 at 730 P.M. , be accepted and ap- proved. Motion carried. 62212. - Moved by Morrissey , seconded by Cavanaugh that the Minutes of the Regu- lar Session of May 22, 1972 at 7 , 30 P .M. and the Minutes of the Special Session of May 25, 1972 at 11 , 30 A.M. , be approved. Motion carried. 62213 - Moved by Cavanaugh, seconded by Miller that the proof of publication of the Notice of Hearing on Proposed Plans and Specifications and Proposed Form of Contract for the 1972 Paving Program Noo 3 and the Taking of Bids for said improvement , Contract Noo 134, be received and placed on file . Motion carried. 62214 - This being the time and place for a public hearing on the matter of the adoption of plans , specifications and form of contract for the construc- tion of the "Wa e.rloo, Iowa, 1972 Paving Program Noo 3 , Contract Noo 134", the Mayor called for any oral objections to the making of said improvements , or to the adoption of the plans, specifications and form of contract , No oral objections were offered and the Clerk reported that no written objections thereto had been filed. Thereupon, it was moved by Dykeman, seconded by Cohea that Resolution Noo 21953 , adopting plans , specifications and form of contract , for the construction of improvements known as the Waterloo, Iowa , 1972 Paving Program No. 3, Contract No . 134, be adopted. On roll call , Cavanaugh, Cohea, Dykeman, Mabrey , Miller and Morrissey voted Aye. Nay ! None < Absent , Keller. Mayor declared the resolution adopted. 62215 - The Mayor thereupon announced that a further purpose of the meeting was to receive, open, consider and tabulate bids for the construction of the Waterloo, Iowa, 1972 Paving Program No, 3 , Contract Noo 134, in accord- ance with the plans and specifications now adopted. B. Trust , be re- ceived and placed on file. Motion carried. 62217 - The Mayor announced the time had arrived to hear objections , if any, and asked if anyone present wished to be heard or make objection, or if any written objections had been filed with the Clerk. No one appeared to object orally, and the City Clerk reported there had been no written objections placed on file. After public hearing and no objections having been made or filed, it was moved by Cohea, seconded by Dykeman that Resolution No. 21954, a resolu- tion approving the sale of Disposal Parcel No. 18 in the Westfield-Vir- den Urban Renewal Area, Project No. Iowa R- 7 and authorizing the execu- tion of the necessary contract for sale of land for private redevelop- ment and deed, be adopted. On roll call , Cavanaugh., Cohea, Dykeman, Mabrey, Miller and Morrissey voted Aye. Nay: None . Absent : Keller. Mayor declared the resolution adopted. 62218 - Moved by Morrissey, seconded by Miller that the communication from the City Engineer, transmitting the request from John Go Miller Construction Co. , Waterloo, Iowa, for permission to construct two 18 ' curb cuts at 1616 Lafayette Street to serve Rath Employees Credit Union new building, as shown on attached plat , and recommending approval subject to the pro- visions of his letter, concurred by the Police Department, be received, placed on file, recommendations approved and permission granted in ac- cordance therewith at no cost to the City of Waterloo, Iowa. Motion carried. 62219 - Moved by Dykeman, seconded by Cohea that the communication from the Di- rector of Public Works , transmitting a Uniform Offer and Acceptance Con- tract with Melva Stufflebeam, Goldie Ea Slindee , James Hazelwood and Joe Hazelwood, wherein the City of Waterloo, Iowa offers to purchase Lot 1, Block 60 , Anthony Baker 's Addition to Village of Waterloo, Black Hawk County, Iowa, adjacent to the City Garage , NW cor. of Black Hawk Street and Twelfth Street , for the sum of $4,000, be received, placed on file , contract approved with provision that taxes payable in 1972 be paid by seller, an up-to-date abstract and deed furnished by seller and approved by the City Attorney , and the Mayor and City Clerk authorized to execute said contract with the above provisions on behalf of the City of Water- loo. Mayor declared the motion carried. 62220 - Moved by Mabrey, seconded by Cohea that the communication from the City Engineer, transmitting the request of Cedar Falls Construction Co., , Inc , Cedar Falls , Iowa, for a sixty (60) day time extension for the comple- tion of the Highway 218 South Widening Program, Contract Noo 129 , in the City of Waterloo, Iowa, and recommending approval, be received, placed on file and request granted. Motion carried. 62221 - Moved by Miller, seconded by Cavanaugh that the communication from the City Engineer, transmitting the request from Leonard J. Burry for per- mission to construct a temporary asphalt driveway without regard to sidewalk grade at 307 Euclid .Avenue, Waterloo, Iowa, together with $3.00 in cash for recording waiver, and recommending approval subject to the provisions of his letter, be received, placed on file, request approved and Resolution Noo 21955, granting permission and authorizing construc- tion irrespective of a later official grade, be adopted. On roll call , Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent : Keller. Mayor declared the resolution adopted. 62222 - Moved by Miller, seconded by Cavanaugh that the communication from the City Engineer, transmitting the request from Ralph Frisbey for permis- sion to construct a temporary asphalt driveway without regard to side- walk grade at 1703 Commercial Street , Waterloo, Iowa, together with $3.00 in cash for recording waiver, and recommending approval subject to the provisions of his letter, be received, placed on file , request ap- proved and Resolution Noo 21956, granting permission and authorizing construction irrespective of a later official grade, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey voted Aye. Nay : None. Absent: Keller. Mayor declared the resolution adopted. 62223 -- Richard Price of the Safety Committee spoke in favor of the sidewalk program, stressing on the safety of children and the need for sidewalks , especially on Downing Avenue. Russell Burt, Chairman of the Safety Committee, also spoke in favor, stating children should be Kept out of the street, and the need to have the sidewalk on Downing Avenue completed by the time school starts in September. Mayor Turner reported Downing Avenue had a steep side which might cause some problems and it might be necessary to install the sidewalk closer to the street in order to prevent a high retaining walla I Moved by Dykeman, seconded by Cohea that the report and recommendations of the Safety Committee on the 1972 Sidewalk Construction Project, re- ferred to the Council-as-Whole under C.R. #62094 of 5/8/72, be received, placed on file and referred to the City Engineer with a report back to the Council on June 19 , 1972 . Motion carried, June 5, 1972 - 4 - 62224 - Moved by Morrissey, seconded by Dykeman that the communication from the City Engineer, reporting on the request of Kenneth French, 1303 Forest Avenue, for paving of five blocks of Randolph Street from Byron Avenue to Leavitt Street, referred to him under C.R. #62133 of 5/15/72, be re- ceived, placed on file, and the City Engineer instructed to report back to Mr, French to find out what the property owners desire. City Attorney, transmitting a Hold Harmless and Idemnification Agreement to the Blackhawk County Municipal Civil Defense Administration for a helicopter made available to the City of Waterloo Police Department be received, placed on file and Resolution No. 21957 , approving said Agreement and authorizing and directing the Mayor and City Clerk to ex- ecute same in behalf of the City of Waterloo, Iowa, be adopted. City Attorney, transmitting Quit Claim Deed dated 5/9/72 from Cedar Hills , Inc , conveying unto the City of Waterloo, Iowa, certain real property in Section 18-88N-12W for access road on Highway 218 South purposes , and recommending approval, be received, placed on file, and Resolution No. 21958, approving and accepting said deed and directing the recording of same , be adopted. Mayor declared the resolution adopted. 62228 - Moved by Miller, seconded by Cohea that the communication from the Com- munity Development Administrator, transmitting a Special Warranty Deed dated 2/10/72 from Deere & Company conveying unto the City of Waterloo, Iowa, certain real property along the west bank of slack Hawk Creek be- tween Westfield Avenue and River Road for dike and service road purposes in connection with the local flood protection project , Unit A. be re- ceived, placed on file and Resolution No. 21959 , approving and accepting said Deed, be adopted. Petersen Associates , June 5 , 1972 - 5 - 62229 - (Continued) Inc . , be received, placed on file, approved and Resolution No. 21960, a resolution of the Waterloo City Council approving the actions of the Low Rent Housing Commission of the City of Waterloo, Iowa, in executing a contract with R. J. Petersen Associates , Inc . , for certain public re- lation services as set out therein and authorizing the Mayor and Clerk to execute said contract , be adopted. Mayor declared the resolution adopted. 62230 - The Engineers having checked the extensions and totals of the bids for the construction of the Waterloo, Iowa, 1972 Paving Program Noa 3, Con- tract No. 134, reported the bid of Cedar Falls Construction Co. , Ince, of Cedar Falls , Iowa, in the sum of $367,504. 70, was the lowest bid recei- ved. Moved by Cavanaugh, seconded 'by Cohea that Resolution No. 21961, making award of contract for construction of the Waterloo, Iowa, 1972 Paving Program No . 3, Contract No, 134, or accepting the low bid of Cedar Falls Construction Company, Inc . , of Cedar Falls , Iowa, in the sum of $367, 504. 70, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey voted Aye. Nay : None. Absent: Keller, Mayor declared the resolution adopted. 62231 - Moved by Miller, seconded by Cohea that Resolution No. 21962, authoriz- ing the City Clerk and Auditor to draw a warrant on the Liquor Profit Fund of the City of Waterloo, Iowa, for part of the 1972 budgeted subsid' in the amount of $10,000 to the Waterloo-Cedar Falls Transit Company, be adopted. Mayor declared the resolution adopted. 62237 - Moved by Cohea, seconded by Morrissey that Resolution Noo 21967 , being a proposed Resolution of Necessity for the Waterloo, Iowa, 1972 Paving Program #1 , Contract Noo 127, be adopted, and the date of hearing set as June 26, 1972 at 7:30 P.M. at the Council Chambers in the City Hall. Mayor declared the resolution adopted. 62241 - Councilman Mabrey raised the question on travel requests , asking do the second level of departments go to meetings or do just department heads go. Mayor Turner reported that each request was taken separately and decided on in this manner.
