REGULAR SESSION

The City Council of the City of Waterloo, Iowa, met in Regular Session in the
Council Chambers of the City Hall in said City at 7 :30 P .M. June 12 , 1972 .
Mayor Turner in the Chair.
Present : Councilmen Cavanaugh, Cohea, Dykeman, Mabrey , Miller and Morrissey.
Absent : Councilman Keller.
Councilman Cnarles Dykeman offered the invocation.
62249 - Moved by Cohea, seconded by Miller that the Agenda, as proposed, for the
Regular Session of June 12, 1972 at 7 : 30 P .M. , be accepted and approved.
Motion carried.
62250 - Moved by Cavanaugh, seconded by Morrissey that the Minutes of the Regular
Session held June 5, 1972 at 7 : 30 P.M. , be approved.

62251 - Moved by Morrissey, seconded by Cohea that the proof of publication of
the Notice of Public Hearing on plans and specifications for Grant Edu-
cational Park, City of Waterloo, Contract Noo 3, and the taking of bids
for the improvement, be received and placed on file :

62252 - The Mayor announced the time had arrived to hear objections , if any , and
asked if any one present wished to be neard or make objection, or if
there were any written objections filed with the Clerk.
No one appeared to object orally , and the Acting City Clerk reported that
no written objections had been filed:
Thereupon, it was moved by Miller, seconded by Dykeman that Resolution
No . 21972, confirming the approval of the plans, specifications , form of
contract , etc . for the Grant Educational Park, City of Waterloo, Contract
No . 3, be adopted.
On roll call , Cavanaugh. Cohea, Dykeman, Mabrey, Miller and Morrissey
voted Aye. Nay : None . Absent : Keller. Mayor declared the resolution
adopted.
62253 - Moved by Mabrey, seconded by Miller that Resolution Noo 21973, ordering
the construction of the Grant Educational Park, City of Waterloo, Con-
tract Noo 3, be adopted.

voted Aye. Nay: None . Absent: Keller. Mayor declared the resolution
adopted.

62256 - The Engineers having checked the bids for the Grant Educational Park,
City of Waterloo, Contract Noo 3, reported that the bid of Denman
Phillips Construction Co. , Inc . of Waterloo, Iowa in the amount of
Base $8,572 , 30, Alternate $8,166.00 , was the lowest legal bid received.
Moved by Dykeman, seconded by Cohea that Resolution Noo 21974, accepting
the bid of Denman Phillips Construction Co. , Inc . of Waterloo, Iowa in
the amount of Base $8, 572.30 , Alternate $8,166.00, for the Grant Educa-
tional Park, City of Waterloo, Contract No, 3, be adopted, subject to
the approval of the Waterloo Community School District .

voted Aye. Nay : None . Absent! Keller. Mayor declared the resolution
adopted.
62257 - Moved by Miller, seconded by Cohea that the proof of publication of the
Notice of Public Hearing on Re-zoning, upon the request of Donald J.
McCready, President of Montrose Manor, Inc . , the City Councils own
motion, and recommendation of the City Planning Commission, to re-zone
all of Lot H, all of Lot F, except E 62. 65 ' of S 150 ' , all of Lot D, ex-
cept W 117 . 35 ' of S 150 ° and except E 140 .9 ° , Allen Heights Addition
(Fairview Avenue and West Louise Street) , in the City of Waterloo, Iowa,
from "R-2" One and Two Family Residence District to "R-3" Multiple Resi-
dence District, as fully described in said notice published in the Water-
loo Daily Courier on May 25, 1972, be received and placed on file.

62258 - The Mayor announced the time had arrived to hear objections , if any, and
asked if anyone present wished to be heard or make objections, or if
there were any written objections filed with the Clerk.
The Acting City Clerk reported there were no written objections on file
and no one appeared to object orally.
After public hearing and no objections having been made, it was moved by
Cohea, seconded by Cavanaugh that an Ordinance be drawn and submitted for
said re-zoning.
On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey
voted Aye. Nay ! None. Absent! Keller. Mayor declared the motion
carried.
62259 - An Ordinance amending Ordinance Noo 2479 , as amended, by adding Sub-Sec-
tion Noo 30 to Section 2A-5, rezoning certain property in the City of
Waterloo, Iowa, was read by the Acting City Clerk.

Moved by Dykeman, seconded by Cohea that the rules requiring ordinances
to be read in full on three separate days be suspended, that said ordin-
ance be recorded as having passed its first , second and third readings ,
and be now placed on its final adoption.

voted Aye. Nays None. Absents Keller. Mayor declared the motion
carried.
62260 - Moved by Mabrey, seconded by Morrissey that Ordinance No. 2599, an Ordin-
ance amending Ordinance No. 2479 , as amended, by adding Sub-Section Noo
30 to Section 2A-5, rezoning certain property in the City of Waterloo,
Iowa, be adopted.

loo Daily Courier on May 16 and 23, 1972, be received and placed on file .

various office equipment, be received, placed on file, and referred to
the Finance and Purchasing Committee with a report back on June 19 , 1972.

62266 - Robert E. Hays , Executive Secretary of the League of Iowa Municipalities ,
gave a brief report on the new Legislative Program, including Home Rule,
Labor Relations , Liquor and Beer Enforcement, Pensions , Roads and Streets .
62267 - Moved by Dykeman, seconded by Cohea that the communication from the City
Engineer, transmitting the request from First United Methodist Church,
Waterloo, Iowa, for permission to construct a storm sewer to serve the
alley in Block 17, Doe 's Addition, between West Fourth Street and West
Fifth Street and Randolph Street and Wellington Street , as shown on the
attached print , for the City of Waterloo to provide staking and inspec-
tion services and to participate in the cost of construction with the
City 's share to be in the amount of $4,950 .00, and recommending approval ,
be received, placed on file , recommendations and said City 's participa-
tion approved, and permission granted in accordance therewith.

voted Aye. Nay: None. Absent: Keller. Mayor declared the motion
carried.
62268 - Moved by Cohea, seconded by Mabrey that the communication from the City
Engineer, transmitting the request from the First United Methodist Church
for permission to pave with asphaltic concrete the Alley, Block 17, Doe ' s
Addition between West Fourth Street and West Fifth Street and Randolph
Street and Wellington Street, for the City of Waterloo to provide staking
and inspection services and to pave the alley approach at West Fourth
Street , and recommending approval, be received, placed on file, recommend-
ations and said City 's participation approved, and permission granted in
accordance therewith.

City Engineer, transmitting letter and work prints no, 4, 5 and 6 from
Northwestern Bell Telephone Company requesting permission to place buried
telephone cables within the area along Cleveland Avenue, south of Falls
Avenue, to be completed prior to November 1 , 1972, and recommending ap-
proval subject to the provisions of his letter, be received, placed on
file, recommendations approved and permission granted in accordance there-
with.

Engineer, transmitting the request from Paul Burk Pontiac Inc. , Waterloo,
Iowa, for permission to construct one 16 ' curb cut on the north side of
Jefferson Street between West Sixth Street and the Chicago and Northwest-
ern Railroad tracks to serve used car lot , as shown on attached plat , and
recommending approval subject to the provisions of his letter, concurred
by the Police Department, be received, placed on file, a 22 ' curb cut and
recommendations approved and permission granted in accordance therewith
at no cost to the City of Waterloo, Iowa.

City Engineer, transmitting the request from Bidwell Realty, Waterloo,
Iowa, for permission to construct one 28 ' curb cut at 951 Elvon Street
to serve swimming pool of Prarie Meadow West , as shown on attached plat,
and recommending approval subject to the provisions of his letter, con-
curred by the Police Department, be received, placed on file, recommenda-
tions approved and permission granted in accordance therewith at no cost
to the City of Waterloo, Iowa.

City Engineer, transmitting the request from Ronald L. Fell for permis-
sion to construct a temporary concrete driveway without regard to side-
walk grade at 2219 Cardinal Drive, Waterloo, Iowa, together with $3.00 -
check for recording waiver, and recommending approval subject to the pro-
visions of his letter, be received, placed on file, request approved and
Resolution No. 21975 , granting permission and authorizing construction
irrespective of a later official grade, be adopted.

on file and permission granted subject to the approval of the Fire Chief.

Lichty in behalf of the Orange Township Community Council requesting
permission to stage a fireworks display on July 4, 1972 at Orange School,

advising that the bonds filed with the City Clerk up to the close of
