Mayor John R. Rooff in the Chair. Roll Call: Anders, Jordan, Krizek, Murphy, Gronen, Berry. Absent: Getty. Invocation by: Reverend James Carstensen, Good Shepard Lutheran Church. Pledge of Allegiance: Councilperson Bill Gronen. 114832 - Jordan/Krizek that the Agenda, as amended to add Item 9a and delete the application for Stingers for a Beer/Liquor license, for the Regular Session on Monday, February 26, 2001, at 5:30 p.m., be accepted and approved. Ayes: Six. Absent: Getty. Motion carried. 114833 - Jordan/Murphy that the Minutes, as proposed, for the Regular Session on Monday, February 19, 2001, at 5:30 p.m., and the Special Session on Thursday, February 22, 2001, at 9:30 a.m., be accepted and approved. PETITIONS FROM PUBLIC 114834 - Krizek/Murphy that communication from Assistant City Planner transmitting request of Fereday Heating Company to vacate, sell, and convey alley abutting property generally located at 1010 Broadway Street for $75.00, together with recommendation of approval of the Planning, Programming and Zoning Commission, be received, placed on file and "Resolution setting date of hearing as March 12, 2001, at 5:30 p.m. in the City Hall Council Chambers on the above described request", be adopted and City Clerk instructed to publish notice of same. DOCUMENTS 114835 - Gronen/Jordan that communication from Superintendent of WPFC/Sanitation & Recycling transmitting Change Order No. 4 for a net increase in the amount of $27,948.00 for work to be performed by Story Construction Company in conjunction with Anaerobic Digesters Project for Water Pollution Control Facilities, Contract No. 550, be received, placed on file and approved and Mayor authorized to execute same. Elliott for tax exemptions on improvements totaling $108,038.00 for property located at 3038 Angeles Drive in the Consolidated Urban Revitalization Area Plan be received, placed on file and "Resolution approving said application", be adopted and City Clerk instructed to forward said application to the Black Hawk County Assessor. RESOLUTIONS TO BE ADOPTED 114839 - Murphy/Gronen that "Resolution setting date of hearing as March 12, 2001, on the F.Y. 2001 Budget", be adopted and City Clerk instructed to publish notice of same. Prior to a vote on the above motion, the following comments were heard. Mayor Rooff stated that meetings for public input on the F.Y. 2002 Budget have been set for March 6, 2001 at 5:30 p.m. at West High School and March 8, 2001 at 5:30 p.m. at East High School. Following comments a vote was taken on the above motion with the following result. Ayes: Six. Absent: Getty. Resolution adopted and upon approval by Mayor assigned No. 2001-66. ORDINANCES TO BE ADOPTED 114840 - Krizek/Jordan that "an Ordinance reestablishing the Self Supported Municipal Improvement District (SSMID) for two years at $2.75 per $1,000.00 of assessed valuation", be received, placed on file, considered and passed for the third time. Ayes: Six. Absent: Getty. Motion carried. 114841 - Fire Chief Frank Magsamen stated that the proposed ordinance will remove or repeal the section that addresses monitoring of fire alarms. Chief Magsamen stated that Central Dispatch now monitors fire alarm users and this section is no longer valid and needs to be deleted from the city's code. Chief Magsamen reported that there are no changes to the fees for false alarms. Chief Magsamen stated that Sec. 14-93, which relates to penalties for violation of the ordinance, will make a violation of the code a municipal infraction. The fees will be set at $200.00 for the first offense, $500.00 for the second offense and $750.00 for each subsequent offense. Chief Magsamen stated he has received one call requesting clarification on the annual fee for alarm users. Chief Magsamen stated that he had incorrectly reported that the annual fee would be $75.00 when in fact it is $72.00. Jordan/Murphy that "an Ordinance amending the Code of Ordinances of the City of Waterloo, Iowa, by repealing Section 14-76, Purpose and Definitions, of Article IV, Alarm Systems, of Chapter 14, Fire Prevention and Protection; and enacting in lieu thereof a new Section 14-76, Purpose and Definitions, of Article IV, Alarm Systems, of Chapter 14, Fire Prevention and Protection; and repealing Section 14-77 through 14-89 of Article IV, Alarm Systems, of Chapter 14, Fire Prevention and Protection; and repealing Section 14-93, Penalties for Violation, of Article IV, Alarm Systems, of Chapter 14, Fire Prevention and Protection; and enacting in lieu thereof a new Section 14-93, Penalties for Violation, of Article IV, Alarm Systems, of Chapter 14, Fire Prevention and Protection (establishing penalty for violation)", be received, placed on file, considered and passed for the first time.
