RESOLUTION NO. 2006-70
RESOLUTION FIXING THE TIME AND PLACE OF
HEARING AND NOTICE TO BE GIVEN ON THE
VACATION, SALE AND CONVEYANCE OF A PORTION OF
GAYLE STREET GENERALLY LOCATED BETWEEN JOY
DRIVE AND RAINBOW DRIVE TO WHITAKER FOODS AS
FEBRUARY 20, 2006, AT 5: 30 P.M. IN CITY HALL
COUNCIL CHAMBERS, WATERLOO, IOWA AND
INSTRUCTING THE CITY CLERK TO PUBLISH THE
NOTICE OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS:
Section 1 . That the Council of the City of Waterloo, Iowa
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa at 5 : 30 p.m. on the 20th day of February, 2006, for the
purpose of considering and acting upon a proposal to vacate, sell
and convey a portion of Gayle Street generally located between
Joy Drive and Rainbow Drive to Whitaker Foods, and legally
described as follows :
That part of the Northeast Quarter (NEB) of Section
Twenty-one (21) , Township Eighty-nine North (T89N) ,
Range Thirteen West (R13W) of the Fifth Principal
Meridian, Waterloo, Black Hawk County, Iowa, described
as follows :
Beginning at the Southeast corner of Lot Three (3) ,
Auditor' s Whitney Road Plat in Sections 16 and 21-89-
13, which is also the Northeast corner of Lot Seven
(7) , Block One (1) , Clyde Miller Heights; thence North
16°14' 08" East Eighty-nine and Twenty-one Hundredths
(89 . 21) feet along the East line of said Lot Three (3) ;
thence North 16°16' 52" East One Hundred Sixty-six and
Seventy-seven Hundredths (166. 77) feet, still along
said East line; thence South 38 °12' 46" East Thirty-six
and Ninety-four Hundredths (36. 94) feet to the most
Northerly Corner of Lot Eleven (11) Clyde Miller
Heights Second Subdivision; thence South 16°13' 54" West
Two Hundred Thirty and Sixty-two Hundredths (230 . 62)
feet along the Westerly lines of said Lot Eleven (11)
and Lots Ten (10) and Nine (9) , said Second Subdivision
to the angle point on the said Westerly line of Lot
Nine (9) which is Eighty-seven and Fifty-four
Hundredths (87 . 54 ) feet, more or less, North of the
Southwesterly corner of Lot Eight (8) in said Second
Subdivision; thence North 81°04' 32" West Thirty and
Forty-five Hundredths (30 . 45) feet to the point of
beginning, containing 7, 337 square feet, all in the
City of Waterloo, Black Hawk County, Iowa;
for $5, 000. 00, plus costs .
Section 2 . That the City Clerk is hereby directed to publish
notice of the time and place of said hearing in the Waterloo
Courier.
