RESOLUTION NO. 2006-120
RESOLUTION APPROVING THE REQUEST OF MODERN
BUILDERS ON BEHALF OF CON-TROL FOR A SITE
PLAN AMENDMENT TO THE "M-2, P" PLANNED
INDUSTRIAL DISTRICT FOR THE PURPOSE OF
CONSTRUCTING A NEW 50, 000-70, 000 SQUARE FOOT
CON-TROL INDUSTRIAL WAREHOUSING BUILDING IN
THE NORTHEAST INDUSTRIAL PARK, JUST SOUTH OF
GRAY TRANSPORTATION SITE IN THE CITY OF
WATERLOO, BLACK HAWK COUNTY, IOWA.
WHEREAS, it has been proposed that the Council of the City
of Waterloo, Iowa, approve a site plan amendment to the "M-2, P"
Planned Industrial District for the purpose of constructing a new
50, 000-70, 000 square foot Con-Trol industrial warehousing building
in the Northeast Industrial Park, just south of Gray
Transportation site, legally described as follows :
Northeast Industrial Park Plat No. 3 Lot 12 except that
part of Lot 12 contained in the following: Northeast
Industrial Park Plat 1 acre parcel of land located in
part of Lots 6 and 7 Northeast Park Plat No. 1 and part
of Lot 12 Northeast Industrial Park Plat No. 3
described as follows : Beginning at the Northwest
corner of said Lot 6, thence North 89 Degrees 34
Minutes 40 Seconds East along the Northerly line of
said Lot 6 642 . 05 feet to the Northeast corner said Lot
6, thence North 89 Degrees 34 Minutes 40 Seconds East
300 feet to the East line of said Lot 7, thence South
along the East line of said Lot 7 225 feet, thence
South 89 Degrees 34 Minutes 40 Seconds West 360 feet,
thence South 285 feet to the Southerly line of said Lot
6 which is also the Northeast corner of said Lot 12,
thence South along the East line of said Lot 12 160
feet, thence South 89 Degrees 34 Minutes 40 Seconds
West 478 . 12 feet to the Westerly line of said Lot 12,
thence North 16 Degrees 47 Minutes 9 Seconds West along
the Westerly line of said Lots 12 and 6 380 . 77 feet,
thence North along the Westerly line of Lot 6 304 . 67
feet to the point of beginning;
And
Northeast Industrial Park Plat No. 3 Lot 13, all in the
City of Waterloo, Black Hawk County, Iowa.
WHEREAS, a public hearing was held on February 20, 2006, at
5 : 30 p.m. , at City Hall Council Chambers, Waterloo, Iowa, as
provided by law, by the Council of the City of Waterloo, Iowa, on
the proposal to approve said above mentioned site plan amendment,
and
WHEREAS, it is the opinion of this Council that said site
plan amendment should be approved as proposed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that a site plan amendment to the "M-2, P"
Planned Industrial District for the purpose of constructing a new
50, 000-70, 000 square foot Con-Trol industrial warehousing
building in the Northeast Industrial Park, just south of Gray
Transportation site, be and the same is hereby approved.

RESOLUTION NO. 2006-121
RESOLUTION AUTHORIZING THE SALE AND
CONVEYANCE OF PROPERTY GENERALLY LOCATED
BETWEEN JAY DRIVE AND RAINBOW DRIVE FOR
$5, 000 . 00, PLUS COSTS, AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AND DELIVER
DEED FOR SAME.
WHEREAS, the City of Waterloo, Iowa, is the owner of real
property in the City of Waterloo, Iowa, as described below, and
WHEREAS, an offer to purchase said certain parcels of real
property in the sum of $5, 000 . 00, plus costs, has been made by
Whitaker Foods, and
WHEREAS, a public hearing was held on February 20, 2006, at
5: 30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as
provided by law, by the Council of the City of Waterloo, Iowa, on
the proposal to sell and convey premises owned by the City of
Waterloo, Iowa, to Whitaker Foods, and
WHEREAS, it is the opinion of this Council that sale and
conveyance should be made as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS:
1. The following described real property, as fully
described in the published notice in the Waterloo Courier on
February 10, 2006, is not presently needed and will not be needed
in the foreseeable future for municipal purposes and its ownership
is serving no municipal purpose, and
2 . That the offer of Whitaker Foods to purchase real
property for the sum of $5, 000. 00, and costs, be and it is hereby
accepted for real property described below:
That part of the Northeast Quarter (NEIa) of Section
Twenty-one (21) , Township Eighty-nine North (T89N) ,
Range Thirteen West (R13W) of the Fifth Principal
Meridian, Waterloo, Black Hawk County, Iowa, described
as follows :
Beginning at the Southeast corner of Lot Three (3) ,
Auditor' s Whitney Road Plat in Sections 16 and 21-89-
13, which is also the Northeast corner of Lot Seven
(7) , Block One (1) , Clyde Miller Heights; thence North
16°14' 08" East Eighty-nine and Twenty-one Hundredths
(89. 21) feet along the East line of said Lot Three (3) ;
thence North 16°16' 52" East One Hundred Sixty-six and
Seventy-seven Hundredths (166 . 77) feet, still along
said East line; thence South 38°12' 46" East Thirty-six
and Ninety-four Hundredths (36. 94) feet to the most
Northerly Corner of Lot Eleven (11) Clyde Miller
Heights Second Subdivision; thence South 16°13' 54" West
