RESOLUTION NO. 2006-327
RESOLUTION AUTHORIZING THE SALE AND
CONVEYANCE OF PORTIONS OF HALLOWELL ROAD AND
WILLOW STREET ADJACENT TO 502 HALLOWELL ROAD
FOR $6, 446. 25, AND SURVEYING COSTS OF
$1, 748 . 25 FOR A TOTAL OF $8, 194 . 50, PLUS
COSTS AND AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE AND DELIVER DEED FOR SAME.
WHEREAS, the City of Waterloo, Iowa, is the owner of real
property in the City of Waterloo, Iowa, as described below, and
WHEREAS, an offer to purchase said certain parcels of real
property in the sum of $6, 446. 25, and surveying costs of $1, 748 .25
for a total of $8, 194 . 50, plus costs has been made by Lynn Piper,
and
WHEREAS, a public hearing was held on April 24, 2006, at 5: 30
p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as
provided by law, by the Council of the City of Waterloo, Iowa, on
the proposal to sell and convey premises owned by the City of
Waterloo, Iowa, to Lynn Piper, and
WHEREAS, it is the opinion of this Council that sale and
conveyance should be made as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS:
1 . The following described real property, as fully
described in the published notice in the Waterloo Courier on April
14, 2006, is not presently needed and will not be needed in the
foreseeable future for municipal purposes and its ownership is
serving no municipal purpose, and
2 . That the offer of Lynn Piper to purchase real property
for the sum of $6, 446. 25, and surveying costs of $1, 748 . 25 for a
total of $8, 194 . 50, plus costs be and it is hereby accepted for
real property described below:

The North 760 feet of the following described parcel:
All that part of the Northeast Quarter of the Southeast
Quarter (NE;ISE-4) of Section No. Nineteen (19) , Township
No. Eighty-nine (89) North, Range No. Twelve (12) West
of the Fifth (5th) Principal Meridian, Black Hawk
County, Iowa, lying North of the North line of the
right-of-way of the Chicago and Great Western Railroad,
lying within the following described boundaries :
Commencing at a point on the North line of the
Southeast Quarter (SDI) of said Section No. Nineteen
(19) that is Six Hundred Fifty-three and Eighty-five
Hundredths ( 653 . 85) feet West of the Northeast corner
of the Southeast Quarter (SE3-1) of said Section; thence
West along the North line of the Southeast Quarter
(SEA) of said Section a distance of Two Hundred
Eighteen and Forty-five Hundredths (218 . 45) feet;
thence South to a point that is Thirty-three (33) feet
North of the South line of said Section and Eight
Hundred Sixty-five and Six Tenths (865 . 6) feet West of

the East line of said Section; thence East along a line
that is Thirty-three (33) feet North of and parallel
with the South line of said Section a distance of Two
Hundred Sixteen and Eight Tenths (216. 8) feet; thence
North to the point of beginning, excepting the West
Fifteen (15) feet thereof conveyed to the City of
Waterloo by Deed recorded in Land Deed Record 110 at
page 245, all in the City of Waterloo, Black Hawk
County, Iowa.
Subject to Easement as established by Easement Record
recorded in Miscellaneous Record 58, at page 91 .

That part of the Northeast Quarter (NEw) and the
Southeast Quarter (SE11) of Section Nineteen (19) ,
Township Eighty-nine North (T89N) , Range Twelve West
(R12W) of the Fifth Principal Meridian, Black Hawk
County, Iowa, described as follows :
Commencing at the East Quarter corner of said Section
Nineteen (19) ; thence S89°33' 29"W Six Hundred Fifty-
three and Sixty-nine Hundredths (653 . 69) feet along the
North line of aforesaid Southeast Quarter (SEk) to the
Northeast corner of parcel described in City Lot Deed
547, Page 471, of the Black Hawk County Recorder' s
Office and to the point of beginning; thence
N00°03' 03"W Thirty-three (33 . 00) feet along the
Northerly extension of the East line of said parcel to
a point on the Easterly extension of the North right-
of-way line of Willow Street; thence S89°33' 44"W Two
Hundred Seventy-seven and Fifteen Hundredths (277 . 15)
feet along said Easterly extension and along said North
right-of-way line to a point on a line Forty-five
(45 . 00) feet West of and parallel to the Northerly
extension of the East line of the West One-third (W1/3)
of the East Half (E1/2) of aforesaid Southeast Quarter
(SE11) ; thence S00°02' 33"E Seven Hundred Ninety-three
and Eight Hundredths (793 . 08) feet along said Northerly
extension and along said parallel line to a point on
the Westerly extension of the South line of aforesaid
parcel; thence N89°35' 37"E Seventy-four and Sixty-two
Hundredths (74 . 62) feet along said Westerly extension
to the Southwest corner of said parcel; thence
N00°06' 39"W Seven Hundred Sixty and Eleven Hundredths
(760 . 11) feet along the West line of said parcel to the
Northwest corner of said parcel; thence N89°33' 44"E Two
Hundred Three and Forty-three Hundredths (203. 43) feet
along the North line of said parcel to the point of
beginning, containing 1 . 504 acres, all in the City of
Waterloo, Black Hawk County, Iowa.
3 . That the City of Waterloo, Iowa, convey said parcels of
real property to Lynn Piper by Deed.
4 . That the Mayor and City Clerk are hereby authorized to
execute and deliver deed to Lynn Piper.
5. That the original of said deed fully executed and
acknowledged is hereby approved and confirmed by the Council.
6. That the City Clerk is authorized and directed to
deliver said deed of conveyance to Lynn Piper upon receipt of the
sum of $6, 446. 25, and surveying costs of $1, 748 . 25 for a total of
$8, 194 . 50, plus costs .
