RESOLUTION NO. 2006-350 RESOLUTION FIXING THE TIME AND PLACE OF HEARING AND NOTICE TO BE GIVEN ON THE PROPOSED AMENDMENT TO DEVELOPMENT AGREEMENT WITH CONAGRA FOODS (HUNT WESSON) FOR PHASE II FOR CONSTRUCTION OF 200, 000 SQUARE FOOT ADDITIONAL WAREHOUSING AND PRODUCTION SPACE FOR PROPERTY LOCATED AT 2701 MIDPORT BOULEVARD, WITH MINIMUM ASSESSMENT OF $13 MILLION, TAX REBATEMENTS FOR 20 YEARS AND RIGHT OF FIRST REFUSAL ON THE ADDITIONAL 25 ACRES TO THE EAST OF THE PLANT SITE AS MAY 8, 2006, AT 5: 30 P.M. IN CITY HALL COUNCIL CHAMBERS, WATERLOO, IOWA AND INSTRUCTING THE CITY CLERK TO PUBLISH THE NOTICE OF HEARING. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: Section 1. That the Council of the City of Waterloo, Iowa shall meet at City Hall Council Chambers in the City of Waterloo, Iowa at 5 : 30 p.m. on the 8th day of May, 2006, for the purpose of considering and acting upon a proposed amendment to Development Agreement with ConAgra Foods (Hunt Wesson) for Phase II for construction of 200, 000 square foot additional warehousing and production space for property located at 2701 MidPort Boulevard, with minimum assessment of $13 million, tax rebatements for 20 years and right of first refusal on the additional 25 acres to the east of the plant site, and legally described as follows: Beginning at the point of intersection of the East line of Leversee Road and the Northerly line of railroad in the Southwest Quarter Section 5, Township 89, Range 13 in the City of Waterloo, thence North to the North line said Section, thence East along Section line to the East line of the Southwest One-Quarter (1/4 ) of the Southwest One-Quarter (1/4) Section 32,
