PROMISSORY NOTE IN CONJUNCTION WITH THE

415;ree (3) , Township Eighty-seven (87) North, Range

- eginning at the Southwest corner of said Northwest
garter (NWT) , thence South 89°45' 10" East Six Hundred
V One and 15/100' s (601 . 15) feet along the South line of
said Northwest Quarter (NW'3) ; thence North 0°04' 45"
East One Hundred Sixty-four and 5/10ths (164 . 50) feet;
thence North 89°45' 10" West Six Hundred Three and
10/100s (603 . 10) feet to the West line of said
Northwest Quarter (NW'-1) ; thence South 0°00' 00" East One
Hundred Sixty-four and 5/lOths (164 . 50) feet to the
point of beginning, subject to present established
roadway over the Westerly Fifty (50 . 0) feet thereof,
containing 2 . 085 acres exclusive of highway, all in the
City of Waterloo, Black Hawk County, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the Release of Real Estate Mortgage dated
May 1, 2006, for payment of Promissory Note in conjunction with
the Kimball South Rural Water Main Project, by and between Tim W.
and Cathy L. Van Den Berg, and the City of Waterloo, Iowa, be and
the same is hereby approved and the Mayor authorized to execute
the same in behalf of the City of Waterloo, Iowa.
PASSED AND ADOPTED this 1st day of May, 2006.
