RESOLUTION NO. 2006-448
RESOLUTION ACCEPTING AND APPROVING CERTAIN
ACQUISITION CONTRACT TO SELL REAL PROPERTY TO
THE CITY AND ACCEPTING AND APPROVING CERTAIN
DEED.
WHEREAS, the City of Waterloo, Iowa, has had the parcel
described herein appraised and the fair market value ascertained,
and
WHEREAS, the acquisition of the hereinafter described parcel
is in conjunction with widening and construction of turn lanes at
the intersection of East Orange Road and Highway 21 .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the contract for the parcel
hereinafter described to sell the same to the City of Waterloo,
Iowa, all of which are situated in the City of Waterloo, Black
Hawk County, Iowa, are accepted and approved and the Mayor and
City Clerk are authorized and directed to execute the same in
behalf of the City and to execute all instruments necessary to
consummate the agreement to purchase the property from the owners
thereof, and the deed for the conveyance of the same are also
accepted and approved and the City of Waterloo is directed to pay
for the property and the incidental expenses necessary to the
consummation of the sale from City funds .

A parcel of land located in the Southwest k of the
Southeast of Section 15, Township 88 North, Range 13
West of the Fifth Principal Meridian, in the City of
Waterloo, Black Hawk County, Iowa, more particularly
described as follows :
Commencing at the South k corner of Section 15; thence
North 88 ° (Degrees) 53' (Minutes) 10" (Seconds) East
(assumed bearing for the purpose of this description)
on the South line of the Southeast ' of said Section 15
a distance of 160 . 90 feet; thence North 00°30' 54" West,
40 . 00 feet to the intersection of the present North
right-of-way line of East Orange Road and the present
East right-of-way line of Iowa Highway 21 (Hawkeye
Road) , the point of beginning of the parcel herein
described; thence continuing North 00°30' 54" West on
the present East right-of-way line of Iowa Highway 21
(Hawkeye Road) , 58 . 85 feet; thence South 77°37' 39"
East, 252 . 35 feet to the present North right-of-way
line of East Orange Road; thence South 88°53' 10" West
on the present North right-of-way line of East Orange
Road, 246. 01 feet to the point of beginning, all in the
City of Waterloo, Black Hawk County, Iowa .
