RESOLUTION NO. 2006-536
RESOLUTION ACCEPTING AND APPROVING CERTAIN
ACQUISITION CONTRACT TO SELL REAL PROPERTY TO
THE CITY AND ACCEPTING AND APPROVING CERTAIN
DEED.
WHEREAS, the City of Waterloo, Iowa, has had the parcel
described herein appraised and the fair market value ascertained,
and
WHEREAS, the acquisition of the hereinafter described parcel
is in conjunction with construction of the Prescott' s Creek Sewer
Project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the contract for the parcel
hereinafter described to sell the same to the City of Waterloo,
Iowa, all of which are situated in the City of Waterloo, Black
Hawk County, Iowa, are accepted and approved and the Mayor and
City Clerk are authorized and directed to execute the same in
behalf of the City and to execute all instruments necessary to
consummate the agreement to purchase the property from the owners
thereof, and the deed for the conveyance of the same are also
accepted and approved and the City of Waterloo is directed to pay
for the property and the incidental expenses necessary to the
consummation of the sale from City funds.

Sanitary Sewer and Water Main Easement
A sanitary sewer and water main easement over, under
and across that part of the Southwest Quarter (SW14) and
the Northwest Quarter (NW1i) of Section Seven (7) ,
Township Eighty-eight North (T88N) , Range Thirteen West
(R13W) of the Fifth Principal Meridian, City of
Waterloo, Black Hawk County, Iowa. Said easement is
Forty-five (45 . 00) feet wide, lying Thirty (30. 00) feet
North and Northeasterly and Fifteen (15. 00) feet South
and Southwesterly of the following described
centerline:
Commencing at the Westerly corner on the North line of
Lot C-4, Southland Park Third Addition; thence
N35°12' 13"E Three Hundred Sixty-two and Sixty
Hundredths (362. 60) feet along the Southeasterly right-
of-way line of U. S. Highway No. 63 (A.K.A. Sergeant
Road) to the point of beginning; thence S48°32' 42"E
Three Hundred Seventy-two and Eighty-nine Hundredths
(372 . 89) feet; thence S73°58' 03"E One Hundred Sixty-
nine and Eighty Hundredths (169. 80) feet to a point on
the North line of aforesaid Third Addition.
The side lines of said easement shall be lengthened
and/or shortened to terminate at said North line and at
aforesaid Southeasterly right-of-way line and as needed

Water Main Easement
A water main easement over, under and across that part
of the Southwest Quarter (SW ) and the Northwest
Quarter (NWT) of Section Seven (7) , Township Eighty-
eight North (T88N) , Range Thirteen West (R13W) of the
Fifth Principal Meridian, City of Waterloo, Black Hawk
County, Iowa. Said easement is Twenty (20. 00) feet
wide, lying Ten (10. 00) feet on each side of the
following described centerline:
Commencing at the Westerly corner on the North line of
Lot C-4, Southland Park Third Addition; thence
N35°12' 13"E One Hundred Eighty-nine and Thirty-three
Hundredths (189. 33) feet along the Southeasterly right-
of-way line of U. S. Highway No. 63 (A.K.A. Sergeant
Road) to the point of beginning; thence N80°10' 28"E
Sixty-five and One Hundredth ( 65. 01) feet; thence
N35°10' 28"E One Thousand Five Hundred Eighty and
Thirty-six Hundredths (1, 580. 36) feet to a point on

lying Twenty-five (25. 00) feet Northeasterly, Easterly,
and Southeasterly and Fifteen (15. 00) feet
Southwesterly, Westerly, and Northwesterly of the
