Meeting held electronically via Zoom due to the ongoing COVID-19 pandemic.
Members present: Batemon, Kajtazovic, Kurtenbach, Young, Van Fleet, and Council Liaison
Sharon Juon.
Moved by Young seconded by Kajtazovic that the Agenda, as proposed, be approved. Voice-vote
Ayes: Five. Motion carried.
Moved by Kurtenbach seconded by Batemon that the minutes of January 27, 2021 as proposed, be
approved. Voice-vote Ayes: Five. Motion carried.
Update on broadband study progress.
Mr. Van Fleet provided an overview of progress made on the draft plan to date. He explained that
the plan is in the hands of board members for review and to date he has been working with legal
counsel and Magellan on finalizing the draft. He anticipates that the plan can be presented to city
council in May.
Moved by Kajtazovic seconded by Batemon to approve the Board Chair's recommendation to
appoint the following individuals to the Broadband Ad Hoc Committee: Randy Pilkington, Amy
Wienands, Chris Fereday, and David LaMarche. Voice-vote Ayes: Five. Motion carried.
Moved by Kurtenbach seconded by Young to adjourn to executive session. Roll call-vote Ayes:
Five. Motion carried.
Chris Wendland, Board attorney, Closed session to discuss a confidential draft document and
competitive utility information, pursuant to Iowa Code Sections 388.9 and 21.5(1)(a).
Moved by Young seconded by Batemon to adjourn executive session. Roll call-vote Ayes: Five
Motion carried.
With no further business before the board, it was moved by Kurtenbach seconded by Kajtazovic
that the meeting be adjourned at 6:07 p.m. Voice-vote Ayes: Five. Motion carried.

Magellan has provid ed a p ro p o s al for the d es ign phas e of a fiber b ackbone
fo r munic ipal s ewer utility and munic ip al s torm water utility p urposes, and
limited in s c o p e to s uch purp o s es , with the c os t of the design p hase to be
allo cated b etween the sewer and sto rm water utilities and eac h utility to p ay
its allo cated p o rtion from available cash o n hand .
W hile Magellan works on the d es ign of the b ac kb o ne fo r sewer and storm
water purpos es , the C ity will exp lo re other potential funding s o urc es for the
d es ign of (1) additio nal b ackb o ne fo r other C ity p urposes, such as, for
example, c ity b uildings, parks , s treets , pub lic s afety, water utility, or o ther
C ity purpos es , and /or (2) d is tribution sys tem for municipal communic atio ns
utility (MC U) p urposes.
A fib er bac kb o ne fo r C ity p urposes would b e able to s upport c urrent or
future expans ion projec ts fo r additio nal C ity p urposes o r MC U purp os es .
If the C ity identifies and allo cates additional appropriate funding s o urc es the
C ity will c oordinate with Magellan fo r an expans io n o f the d es ign phas e b y a
s upplemental or amended contac t with Magellan, which has provid ed c os t
es timates fo r s uch exp anded d es ign wo rk if the C ity d etermines to proc eed
with expanded d es ign.
Dep ending on the o utcome o f the d es ign p has e, the s cope thereo f, and the
d eterminatio n o f funding s o urc es , the C ity will determine whether to pro c eed
with cons truc tion and financ ing for the pro jec t or p ro jects , with financing
s ubjec t to hearing(s ) and /or electio n d epend ing on the s cope and p urpos es
o f the p rojec t and the type o f financ ing. T he C ity will c o o rd inate with the
Board o f Trus tees of the Municipal C o mmunic ations Utility (MC U)
regarding any d es ign, cons tructio n o r financ ing o f distrib utio n s ystem fo r
MC U p urp o s es bec ause the Bo ard of Trus tees is the governing b o d y for the
MC U.
All financ ing and MC U matters remain subjec t to legal review and
compliance on an ongoing b as is as well as final actio n b y the C ity C o unc il
and Board of Trus tees , as applic ab le.
