RESOLUTION NO. 2005-184 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF PROPERTY GENERALLY LOCATED ALONG SAN MARNAN DRIVE BETWEEN SEARS AND PENNEY' S STREET INTERSECTIONS AT THE LOCATION OF THE FORMER COUNTRY KITCHEN, GREAT DRAGON, AND AUTO REPAIR BUILDING FOR $1. 00, PLUS COSTS, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcels of real property in the sum of $1 . 00, plus costs, has been made by Gerald Schoenfelder, and WHEREAS, a public hearing was held on March 7, 2005, at 5 : 30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Gerald Schoenfelder, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on February 25, 2005, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2 . That the offer of Gerald Schoenfelder to purchase real property for the sum of $1. 00, and costs, be and it is hereby accepted for real property described below: A parcel of land located in the East of Section 2-88- 13, Waterloo, Black Hawk County, Iowa, described as follows : Commencing at the intersection of the Southeasterly right-of-way line of East San Marnan Drive (formerly Iowa State Highway 412) with the West line of the East of said Section 2; thence North 48°36' 00" East along said Southeasterly right-of-way line a distance of 926. 04 feet to the point of beginning; thence along said Southeasterly right-of-way line a distance of 450 . 71 feet to the Southwesterly right-of-way line of Sears Street; thence North 41°24' 00" West a distance of 35 . 49 feet; thence South 48 °36' 00" West a distance of 449. 82 feet; thence South 41°24' 00" East a distance of 50 . 00 feet to the point of beginning, subject to retention of utilities easement over, under and above the above described property. The Southwesterly right-of-way line of Sears Street is assumed to bear North 41°24' 00" West, all in the City of Waterloo, Black Hawk County, Iowa.
