RESOLUTION NO. 2005-291 RESOLUTION FIXING THE TIME AND PLACE OF HEARING AND NOTICE TO BE GIVEN ON THE PROPOSED DEVELOPMENT AGREEMENT WITH POYNETTE DEVELOPMENT LLC TO SELL AND CONVEY FOR $1 . 00, PLUS COSTS, PROPERTY LOCATED ON A FIVE-ACRE PORTION OF LOT 12, MIDPORT AMERICA PARK PLAT NO. 2, TO CONSTRUCT A NEW 16, 625 SQ.FT. FED EX GROUND FACILITY ON PROPERTY GENERALLY LOCATED ALONG THE NORTHERLY SIDE OF AIRLINE HIGHWAY, JUST EAST OF THE RAILROAD TRACK CROSSOVER, AS APRIL 25, 2005, AT 5 :30 P.M. IN CITY HALL COUNCIL CHAMBERS, WATERLOO, IOWA AND INSTRUCTING THE CITY CLERK TO PUBLISH THE NOTICE OF HEARING. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS : Section 1 . That the Council of the City of Waterloo, Iowa shall meet at City Hall Council Chambers in the City of Waterloo, Iowa at 5 :30 p.m. on the 25th day of April, 2005, for the purpose of considering and acting upon a proposed development agreement with Poynette Development LLC to sell and convey for $1 . 00, plus costs, a five-acre portion of Lot 12 , MidPort America Park Plat No. 2 , to construct a new 16, 625 sq. ft . Fed Ex Ground facility on property generally located along the northerly side of Airline Highway, just east of the railroad track crossover, with minimum taxable value of $1, 250, 000 . 00 and tax rebates for five years at 50 percent per year, and legally described as follows : Part of Lot Twelve (12) , Midport America Park Plat No. 2 , Part of the Southeast Quarter (SE 14) of Section Four (4) , Township Eighty-nine North (T89N) , Range Thirteen West (R13W) , of the Fifth Principal Meridian, Waterloo, Black Hawk County, Iowa, described as follows : Commencing at the Southwest corner of aforesaid Lot No. Twelve (12) ; thence South 89°29' 09" East One Hundred Sixty-one and Forty-five Hundredths (161 . 45) feet along the South line of said Lot to the point of beginning; thence North 00°30 ' 51" East Five Hundred Five (505 . 00) feet to a point on the East line of a Thirty (30 . 00) foot easement; thence South 89°29' 09" East Four Hundred Twenty (420 . 00) feet; thence South 00°30' 51" West Five Hundred Five (505 . 00) feet to a point on aforesaid South line; thence North 89°29' 09" West Four Hundred Twenty (420 . 00) feet along said South line to the point of beginning containing 4 . 869 Acres, all in the City of Waterloo, Black Hawk County, Iowa. Section 2 .
