RESOLUTION NO. 2005-304
RESOLUTION ACCEPTING THE ASSIGNMENT AND QUIT
CLAIM OF A PRIVATELY CONSTRUCTED SANITARY
SEWER SYSTEM FROM YOUNGBLUT CONSTRUCTION
COMPANY, INC.
WHEREAS, Youngblut Construction Company, Inc . , and the City
of Waterloo, Iowa ("City" ) entered into an agreement dated January
9, 1978, and filed in the office of the Recorder of Black Hawk
County on January 27, 1978, which provided that Youngblut
Construction Company, Inc . , would construct a private sanitary
sewer (the "Agreement" ) , and
WHEREAS, the Agreement provided that fifteen (15) years after
the date of the Agreement, the sanitary sewer system and all
necessary easements would be conveyed to the City, and that the
City would accept responsibility for operation and maintenance of
the sanitary sewer system, and
WHEREAS, the sanitary sewer system was constructed on real
estate described as follows :
"An easement 30 feet in width located in the Northeast
Quarter of the Southeast Quarter of Section 13-88-13 ,
Waterloo, Black Hawk County, Iowa, and lying 15 feet on
each side of the following described center line :
Commencing at a point on the North line of the
Northeast Quarter of the Southeast Quarter of said
Section 13-88-13 , said point being 15 . 00 feet East of
the Northwest corner of the Northeast Quarter of the
Southeast Quarter of said Section 13-88-13 ; thence
Southeasterly to a point on the South line of the
Northeast Quarter of the Southeast Quarter of said
Section 13-88-13 , which is 495 . 73 feet West of the
Southeast corner of the Northeast Quarter of the
Southeast Quarter of said Section 13-88-13 , all in the
City of Waterloo, Black Hawk County, Iowa; "
and
WHEREAS, Youngblut Construction Company, Inc. , has presented
to the City an Assignment and Quit Claim of Easement which should
be accepted by the City, as conveyance and fulfillment of the
Agreement .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the Assignment and Quit Claim of
Easement, a copy of which is attached to this Resolution, is
hereby received and accepted as fulfillment of th . "creement
